*Nice dueling set. . . . I actually usually wear a patch over my eye and have some sort of knife carried between my teeth.
*Back to the sweet muzzleloaders - I will challenge anyone to a duel. Call it.
*How F'ing cool would that be, seriously, - dueling in abandonment.
*What on earth would the cops say if they picked you up in a Kirk somewhere trespassing with $2000 worth of photo equipment. . . . . . . and a loaded 18th century handgun?

I roll with a 6d maglite, I'm also 6'4" and 280 lbs. my friend, who usually goes with me, is 6'5" and something like 230. i guess that scares people off. giving the bums a beer/ciggy doesn't hurt either.

Thats a good question. The BATF doesn't consider black powder weapons to be "Firearms". Even convicted felons are allowed to purchase black powder weapons. So would a cop be able to charge you with illegally carrying a weapon if you had something like a cap and ball revolver. I'm thinking not. Of course laws vary from state to state but here is SC law check this out. Specifically the definition of a firearm.

It is still a firearm, just not a defined as handgun. If your carry this loaded where handguns are prohibited, or use it to commit a crime, or are a convicted felon...you be boned. I wouldn't try it.

SECTION 16-23-10. Definitions.

When used in this article:

(1) "Handgun" means any firearm designed to expel a projectile and designed to be fired from the hand, but shall not include any firearm generally recognized or classified as an antique, curiosity, or collector's item, or any that does not fire fixed cartridges.

Why would you be "boned". It specificly says that firearms that do not load fixed cartridges are not defined by law as handguns.

As far as generally being considered firearms.

f) "Antique firearm" means any firearm not designed or redesigned for using rim fire or conventional center fire ignition with fixed ammunition and manufactured in or before 1898 (including any matchlock, flintlock, percussion cap, or similar type of ignition system or replica thereof, whether actually manufactured before or after the year 1898) and also any firearm using fixed ammunition manufactured in or before 1898, for which ammunition is no longer manufactured in the United States and is not readily available in the ordinary channels of commercial trade.

The section dealing with transport of firearms is followed by this.

SECTION 16-23-270. Article not applicable to antique firearms.

The provisions of this article shall not apply to antique firearms.

Certainly you can't carry one into a airport or to the state house weapons of all kinds are prohibited in such places, but as for into and abandoned building I don't see a problem. The law pretty much says that you can't carry it anywhere that you would not be able to carry a normal handgun with a concealed carry permit. The difference is you don't need a concealed carry permit to carry a "antique firearm" to non restricted locations.

As for being caught with a weapon while trespassing and getting an additional sentence for possessing a weapon during a crime.

SECTION 16-23-490. Additional punishment for possession of firearm or knife during commission of, or attempt to commit, violent crime.

(A) If a person is in possession of a firearm or visibly displays what appears to be a firearm or visibly displays a knife during the commission of a violent crime and is convicted of committing or attempting to commit a violent crime as defined in Section 16-1-60, he must be imprisoned five years, in addition to the punishment provided for the principal crime. This five-year sentence does not apply in cases where the death penalty or a life sentence without parole is imposed for the violent crime.

I dont think simple trespassing is a violent crime.

And as always this only deals with SC law.

Don't by so sure that it's covered by another statue. A more severe one. Intent while trespassing determines the severity of the charge. Carry a firearm demonstrates premeditation to cause serious bodily harm.

I can think of a few cops and concealed weapons permits holders that would take offense to the idea that carrying a firearm is equal to "premeditation to cause serious bodily harm." or worse yet premeditated murder. You are completely correct that intent is very important but I can't personally accept that simply carrying a firearm represents the intent to commit a crime. If its legal then its legal even if it is frowned upon, just be extra sure that its legal. As for "better you than me" yes the law a very tricky subject, lawyers and judges work with it everyday an I don't think they even totally get it. Ultimately it is up to each of us to decide to what extent we are willing to walk the line. If you're gonna do it be careful not to fall over the edge.

Now this is getting stupid; and nitpicky. A guy robs a bank with a fucking Kentucky longrifle, the point is he robbed the bank with a weapon, guilty. But who the fuck carries a Kentucky longrifle exploring (although it would make for a killer picture)? But seriously, that is just plain stupid.

Next time I go do anything worth while, I'm going to wear a fucking tricorn hat and bring a musket.

I can just see the battlines drawn between the intrepid colonial explorers and the vagrants (allied with the crips).

Me "Tonight we fight the godless hobos and gangsters! Who will stand with me!"

AAAYYYYYE!

"Gentlemen, load !" (Flurry of activity) "Don't fire till you see the Meth teeth and the bloodshot eyes"

Of course I would have to ride a horse to make this real, but hell.

"FIIIIIIIRE!" boom bababoombobom boom crack echo" The smoke clears. In front of the colonial explorers are the dead first wave of hobos and crips. MD 20/20 bottles, discarded needles, Hustler magazine, and once fired .38 specials are everywhere amongst the pile of bodies. But they'll make another advance.

"Reload! Fix Bayonets! CHARRRRRRRRRGE!"

Holy shit I just gave myself a hardon just thinking about it.

I've always had the utmost respect for those men, enduring freezing cold, little supply, and at the same time I've had the utmost respect for Brit regulars, even the Hessians, who the hell could maintain proper "etiquettte" after dragging cannon 100 miles over indian trails (trust me I live there). And then when you get to your destination you expected to look good and follow proper order of battle. Nuts.

Enough thread derailment tonight.
