Anyone remember going here?

I went as a child. Its been closed since 1993, and I was doing some reading and found this article:

The guy was trespassing, got injured, sued the owners and they lost their property to him. Thats just not right.

Just wondering if anyone had been recently and what state its in?

So now HE owns the liability of the place. Some people just don't know what they are getting themselves into. So now when I go back for another visit, and I get hurt, I can sue him and then I'll own the place.

And then the next schmoe can sue me, and on and on and on

You guys have inspired me. I'll do it at the Baker. I'll go in, fall over the old lady who is sleeping there, then sue the current owner. I will then be granted a summary judgement and awarded ownership.

Then 2X can supply the beer on the weekends, and hell, it's a Baker Party Extravaganza.

One thing though, after I own it, none of you drunk ass bastards better be falling down! I'll kick your inebriated ass!

As usual, there is much more to the story than these little news snippets put forth, which makes them sound so much more outrageous.

But basically: The owner of the property knew the ATV rider was there, and he had spoken to him. He had a steel cable strung across the road, at exact ATV rider neck-height, with no markings or flags on the cable.

We all trespass -- how would you feel if the owner booby-trapped the place and you fell in a hole and broke your spine or something, leaving you in a wheelchair for life? Would the excuse "Yeah, but he was trespassing!" really justify what happened to you?

Freakin' amazes me how journalism seems to leave out what Paul Harvey used to call "the rest of the story".

Either way though, I think the plot is now in motion for me to own the Baker. The wheels of justice cannot be stopped!

I didn't -- Mchelem posted this thread, remember? The story intrigued me so I dug around on the intertubes to find an actual verdict/etc, so I could read the whole story and not the one the news media published.

I read the whole thing: The testimony from the two sides doesn't line up, of course, but at the very least, the owner of the property never asked the ATVers to leave the property.

I wasn't meaning that you were the original poster, I was referring to the fact that you dug up the Supreme Court case on this and read it. lol

I'm reading it now. I'm only at the 4th page. I'll read the whole thing. So far though, I'm not sure the owner did this maliciously. Sounds like he just gave them permission to ride and they got hurt. I haven't seen anything yet that makes me think the man purposefully put that cable there, at that exact height, so the he could intentionally rip someone's head off. The cable was just there, from whatever previous reason it had been placed there.

No doubt this is a tragic situation, but was it really anyone's fault? The only thing I see is, like you said, the fact that he gave them permission to ride there. But I'm not sure that would transfer the risk to him since the riders are the one's responsible for watching where they are going.

If I'm driving a 4 wheeler and I'm watching the highway off to my right while I drive straight off a cliff into a river, do I really get to sue God who put the river there? I'm just sayin'.

I think sometimes tragic accidents which are just that, accidents, get blown up into a mountain of legal gun fighting that then makes ever property owner in the world understandably reluctant to let anyone do anything.

Keep reading -- the owner's son went and put the cable up mere minutes before he ran into it.

He may not have been trying to kill anyone, but he definitely put it up with the purpose of stopping or damaging ATVs that came through there, since it was unmarked.

Your "god" analogy falls flat because we're talking about a cable, not a river, and it wasn't put there by nature, it was put there by a person.

I've read that part since my last post. By why for crying out loud, would I give person X permission to ride on my property, and then tell my son to go hang a cable across the path? Even if the intent wasn't to hurt the person, why would he do that KNOWING that the vehicle would be damaged?

I could understand it if he put the cable up there after having told them NOT to ride there. But giving them permission? And then purposely setting up this situation with intent?

If he did that then yeah, he should be liable. But honestly, the logic of a reasonable person doing that just doesn't make sense to me. Especially after the owner stood around and "chatted" with the guys father, talked about what they were doing with the property.

It all sounds like acquaintances that had no intent to harm the guy. I've had to break my reading of it a half dozen times, but I don't think I've missed that much.

I am not going back to read the entire trial, sorry....and I apologize for posting the story without doing all my research.

I can see both sides of this. As a business owner, who had my office/warehouse broken into, and things stolen, vandalized etc. I will admit I wanted to booby trap my office so if those little punk a$$wipes came back, they would get the shock of their life. But, I can't say I wanted to literally take their heads off or kill them. I wanted to shake them up a little and make them think about it the next time they go to break into a building. I imagine land owners get tired of people trespassing, especially if they've already told you once or twice to stay off their land. Gut reaction is to take matters into your own hands. Especially if the police don't care. If the son did string a cable up with intentions of taking their heads off, then yes, he should be held responsible. Would it be feasible for the owners of the baker to cut holes in the floors and throw rugs over them with the intentions of hurting anyone who entered? No, but I can see them WANTING TO. There are also laws AGAINST booby traps, as I found out when I mentioned it to the officer who responded to our break-in. I would hate to lose my business because I shot some kid who was trespassing and now he can't walk and he sued me and won.
However, as a citizen who may or may not go into buildings and houses that do not belong to me, that might or might not have a sign that says no trespassing, private property, I honestly can't see falling through a floor of the Baker and then suing the city of Ednaville. I know it's private property. I know it's against the law to trespass. I know that the building is in poor shape and that its dangerous to go into it. Its a risk I take on myself if I should choose to enter that dilapidated, crumbling building. America is just too sue happy in my opinion. Spill hot coffee on yourself in the drive through window? Sue McDonalds. Get fat from eating fast food everyday? Sue taco bell. Trespass on private property and hurt yourself? Sue the owner. Somewhere in there, we have to take responsibility for ourselves and our actions. Common sense should prevail.


Edited to add: I dont know Billy and I don't want to push him down a flight of stairs. Unless of course, he's the little shitwad who broke into my office-in that case, can I have my pink laptop back??
