Trespassing Question

*Note, I did do a search and read local trespassing laws, this is a question I couldn't find an exact answer on.

Okay so here is the question. You are trespassing on private property. At some point, the cops or security are called and they begin searching the property but don't find you.

You find some way off the property without being seen. You are now on public property and walking away, back to your car, acting innocent, etc.

The cops and/or security stop you outside the property and question if you were in the property. You say NO.

At this point, can you still be arrested and/or detained for trespass? Assume that you were not seen at any point inside the property.

they cant do shit with out proof.

as long as you're not like some of the idiots on the other coast and dont take/ break stuff ( like radiators off the roof ) you are good to go.

Or have admin blds tattooed (like my new tag line?) on their asses making for easy ID... most cops don't have time to waste playing hide and seek.

They might haul you in just for giggles if someone is being just too funny... it's an 8 hour shift, they still get paid.
What if... they DO drag his ass downtown anyhow... just for giggles?
Maybe one of those police interrogators will break SirJinx like a 350 pound chorus girl slipping on a banana.
Sitting too close to the action can get messy.

You should understand your state and federal trespass and B&E laws. Avoid turning a hobby into a costly career decision.

In general though, avoid pissing off cops; lying by omission is only such if you don't snicker when you do it!

While the law would most likely be in your favour, the street outside an abandoned building sure as shit aint no court room, and your average cop sure as hell aint no judge.
Its been my experience with the police that, while being polite and courteous is always going to act in your favor...all it takes is one prick cop to decide hes going to make an example of you or "teach you a lesson" and it doesnt even matter who you are, who you know or if you were doing anything wrong at all.

The key things to keep in your head is this public land? Did anyone see me in the site or coming out of the site?! If the officer suspects that you were in the site or there was a witness that saw you, then my understanding a detention would be somewhat ethical. However, my understanding is they CAN NOT SEARCH YOU! A warrentless search has limits to the reasons they can be conducted! However as always, plain site rules apply. If your camera is in visible sight, then the rules change a little. The important thing to remember is if they ask if they can search, look at your stuff, just say no!

On a side note, don't come on here and be a dick, bad mouthing mods never helped anyone! We're all glad that your the god of explorations, but please respect the community.....

It's like the smoking gun theory... you might be caught holding the gun but proof is still required that you fired it. Trespassing is the same concept... you might be near the property, but unless there is a witness...

If they can't prove it, they legally can't do anything, but that doesn't mean they wont. If a cop asks to see whats on your camera, say they can't. You don't have to consent to a search until you are placed under arrest.

What everyone else said is true. However, keep in mind that just because you weren't seen on the property doesn't mean you can't be arrested for it. Sure you probably wouldn't be convicted but just the whole process would be enough of a financial burden that itself would become your "sentence".

Depending on where you live dictates the specific laws in question, but here in Ontario, a Police Officer or Security Guard can still arrest you off property if he/she has good reason to believe youy were up to no good on the property.

Not sure how long it is in the US, but they sure as hell can detain you while they sort things out.

They can also search you for weapons if they fear for their safety or others. They have a lot of gray area to work with if you act like an asshole.
