| | | *Note, I did do a search and read local trespassing laws, this is a question I couldn't find an exact answer on. Okay so here is the question. You are trespassing on private property. At some point, the cops or security are called and they begin searching the property but don't find you. You find some way off the property without being seen. You are now on public property and walking away, back to your car, acting innocent, etc. The cops and/or security stop you outside the property and question if you were in the property. You say NO. At this point, can you still be arrested and/or detained for trespass? Assume that you were not seen at any point inside the property.

Or have admin blds tattooed (like my new tag line?) on their asses making for easy ID... most cops don't have time to waste playing hide and seek. They might haul you in just for giggles if someone is being just too funny... it's an 8 hour shift, they still get paid. What if... they DO drag his ass downtown anyhow... just for giggles? Maybe one of those police interrogators will break SirJinx like a 350 pound chorus girl slipping on a banana. Sitting too close to the action can get messy.

However, my understanding is they CAN NOT SEARCH YOU! A warrentless search has limits to the reasons they can be conducted! However as always, plain site rules apply. If your camera is in visible sight, then the rules change a little. The important thing to remember is if they ask if they can search, look at your stuff, just say no! On a side note, don't come on here and be a dick, bad mouthing mods never helped anyone! We're all glad that your the god of explorations, but please respect the community.....

Sure you probably wouldn't be convicted but just the whole process would be enough of a financial burden that itself would become your "sentence". Depending on where you live dictates the specific laws in question, but here in Ontario, a Police Officer or Security Guard can still arrest you off property if he/she has good reason to believe youy were up to no good on the property.

They can only hold you if you are under arrest, and they can only arrest you if you have done something wrong. If a cop is telling you to stay where you are, ask if you are under arrest. If they say no, you can just leave.

Not sure how long it is in the US, but they sure as hell can detain you while they sort things out. They can also search you for weapons if they fear for their safety or others. They have a lot of gray area to work with if you act like an asshole.
