| | | Oh, my ... I got hammered for three solid years over a simple trespassing charge in Texas: https://uer.ca/for...=130209&currpage=1 http://www.uer.ca/...rrpage=2&pp#post33 After all that pain and suffering, why do I still do this, you ask? I guess I’m addicted. Edit: I will say that I’ve done this long enough now to get caught quite a few times, both by law enforcement and also by someone outside of law enforcement (i.e., owners and such). There is only one other time was I punished legally, and it was a ticket (fine only). I’ve been let off with a warning (searched one time) every other time. Consequences outside of “the law,” include; Having my car towed (out of state!), some very scary dog issues, and three times I’ve been approached by an owner with a firearm. It’s Texas, btw, so the gun toting property owners are kind of expected!

| | | This is a cut-and-paste from the first link in my above post. I’m pasting it because it’s kind of buried in that linked page (and I’m too lazy to retell the whole story right now and I still can’t fall asleep so y’all are stuck with me): For context, the thread was titled, Are “They” Watching Us? About two years ago, I sat in the back of a North Texas courtroom reading a police report my attorney had just handed to me starring myself and a friend of mine, (who was also known as the "co-defendant" in this context). Although not quite as front and center as we were in this report, there was a group that I belonged to included within its pages - complete with screenshots, photographs, and commentaries by the two of us as well as other members. The information included both public and private threads, so these detectives didn't seem to have any trouble accessing much of the "members only" information. The group was not UER, but it was basically a local sister group with the same stated goals and interests. I was able to see all of this because I was charged with a class A misdemeanor and this was my "discovery" phase of this wretched process. I was charged and ultimately placed on a 2 year deferred probation for trespassing in a Dallas suburban area and exploring an abandoned house. Three years later, I'm still not done with this nightmare. My point is, they can and they do read this shit and the will absolutely use it against you if given the resources and opportunity! Seeing all of that stuff laid out in my own criminal indictment was both surreal and chilling to say the least. They use this stuff a lot more often than people think. Especially police departments like this suburb I had the misfortune of wandering into because they have almost no crime and lots of time and money and resources to spend looking at sites like this one. The above example might be anecdotal to you guys, but it was sure as hell real to me and I hope this is a lesson I never never forget. Ideally, I'd like for my experience to at the very least spare one of you guys from making the same mistakes I did by publishing too much information. I created a blog and subsequent post of that location anonymously, but my digital stealthiness was half-assed and I knew it the moment when I hit enter on my keyboard. I just didn't think it was important enough to matter until it was too late.

| | | Things are very different here in the UK, more in line with what Steed posted. I've had encounters with police only a small handful of times here in the UK, and the normal procedure is that they would ask the standard questions such as 'what are you doing here?' 'how did you get in?' etc, followed by a search of myself and whatever vehicle we were in just to ascertain we didn't have anything stolen on us, or tools for breaking in etc or anything else illegal. Once that it's established there is nothing illegal or suspicious on us there usually follows a bit of a telling off and then no further action, as trespass in and of itself isn't a criminal offence here so the police usually can't do much except tell you to leave. However last year I came very close to being arrested here, as the officers who stopped us tried to pin a charge of attempted burglary on us - and they were very ready to arrest both me and my friend, however thanks to the landowner saying there was no damage at all to his property, and the fact we had nothing on us, we avoided it, just. Being arrested for exploring in the UK can happen, although it's rare, and it's usually reserved only for the more high-risk sites in the larger cities which careless people get caught at. I've also been caught by police in a mill in France, they came in eight or nine strong all with their guns and everything but as soon as they saw we had cameras and stuff it was absolutely fine, they were really nice. We got escorted out and found our car - the only UK registered car on the street - boxed in by their cars.

| | | Two more anecdotes came to me. Once I was caught deep in an active underground bullet train system. Police kept me for a few hours, seeming to want to rule out terrorism. I laughed off the idea of Canadian terrorists but they were at least just being diligent. They kept me a few hours and played a few tricks to pry extra far. -When I showed them a map on my phone showing I had been on my way home, then gave it to a cop, he exited the map and checked my text messages before I could do anything. -When they heard I worked for a government office, they tried to obtain my permission to search the office, even though it was like 2am on a weekend. I told them absolutely not. I was let go without any charges. Another time, a security guard caught me driving through an abandoned neighbourhood with a helmet cam, and police were called. I asked what crime I had broken and none of them could answer. Finally it was determined I hadn't broken any laws, but I should've asked for permission from the local government office first, seemingly as a courtesy. Of course I doubt these conditions exist in any other country.

So... Get busted doing something cool then chill for 6 months? Doesn't seem too bad. If you get the nickel ride a second or third time can they bring up your previous incidents?
| I’m not sure about NY specifically, but I do know that dismissals still show up in the database (NCIC, and here in Texas, TCIC). As soon as the charges (and usually, an arrest) were officially made, you were added to the system and will remain in the system. A dismissal only means you weren’t convicted of a crime, it doesn’t assume guilt or innocence and law enforcement can still see this information in your background report unless you manage to somehow get the charges expunged. In Texas, a true expungement is almost impossible, even if charges are dropped or dismissed.

| | | Climbed the baseball bat in front of the Social Security building in Chicago, no sign prohibiting it and I came back down when the guards started yelling at me. Reckless conduct charge, 13 hours in holding then out with an Own Recognizance bond, guards never showed for court so it got dismissed.
Butter knifed a door open on the third floor of a high rise construction site stairwell, didn't see the motion cam tucked up above the sprinkler pipes. k9 found us hiding in a bathroom on the penthouse level. Cops were PISSED they had to climb all them stairs. They also made a remark about how I had the door open in less than a second. Booked on felony burglary, stayed three days in jail before we could get an OR bond, ended up doing a deferral pending 15 days on the DOC work crew cleaning up illegal dumping sites and unhoused encampments. Climbed the Vincent Thomas in Long Beach then climbed one of the towers of the new Gerald Desmond bridge. Didn't realize until we came back down that we passed a monitored camera on a gas pipeline valve. Cops responded because three randos are walking toward a construction site in the middle of the Port of Long Beach at 2am. 7 squad cars respond and search the whole site with lights as we watched from 500 feet up. I guess they couldn't get a k9 out there so they never found us, all but one car left after 2 hours. We climbed down and made sure to walk back to the public street without being seen by any more cameras. As we walked to the car we noticed the gas pipeline cam was tracking us as we walked by, rotating on its base. About two minutes after that we got swarmed by three cars on the street and peppered with questions. We told them we were taking pictures of the waterfront and gave no further answers, they searched our bags and the captain (no, not a sergeant) seemed to be on his cell phone with someone when running our names, not his police radio. After listening to the response from his cell phone his whole demeanor changed and he let us go without even checking our cameras for pictures. I'm pretty sure he was talking to a DHS fusion center who very much know about urbex and urbexers.
Complacency is bad, folks.

| | | I've been caught a couple of times by police, and both times I managed to squeak by without charges. First time was at a racetrack; the gate was open, no 'stay out' signs...I drove in and began photographing. After about 20 mins I come out of the owner's box to see a county sheriff car below. I approached and greeted him, and the first thing he says is, "A local lawyer owns this property and he's real adamant about prosecuting trespassers." I of course apologized, and told him why I was there. He wanted ID, but saw my pocketknife, and asked if I had any other weapons. I admitted that I had some pepper spray, and a pistol in the glove box of my car (I don't ccw on explores, but I was out of state on this trip, so I [legally] carry on long trips). Once he checked and unloaded the gun, I gave him my ID and he spent 5 minutes calling it in. He then told me, " It'd be a real pain for you to drive all this way for the court date...we're gonna let this go, since you're clearly not causing trouble, but you don't want to come back, do you?" I allowed that I'd like to, but that I would not. He also said that they'd had a pretty serious squatter issue a few months ago, and they had just run them all out. The second time was last month. Abandoned correctional facility, one I'd infiltrated and partly explored about a year ago. The place looked a bit more sealed than last time. I got lazy...I could've parked a block away and walked, but I found a somewhat inconspicuous access road on the property, and parked there. Found an easy PoE (rather than looking for one that was more discreet), climbed in, and began photographing the cell blocks, which was a new area to me. EIGHT PICS, PEOPLE! That's all I got until I started hearing voices...and realized they were coming from outside. I look out and see 3 cop cars around my car. I jump out of the window, hoping they didn't see me inside (they did), and approach them. We go through the same old oatmeal; one guy goes in the building while another searches my backpack. They quickly determine I'm not a vandal, squatter, or thief, and proceed to call me in. The whole time they're asking me about the hobby, and about where I've been and so on. Also found out somebody had seen me and called the police. Eventually, we walk back to the vehicles, and they tell me they called their captain (town cops, and the town owned the building) and told him that I did enter the property illegally, but that I clearly wasn't causing any trouble. In the end they had me sign a 'Notice of Trespass', which is not an official charge, but ensures that if I were to be caught on the property again, I would likely be arrested and charged right off. What got me about this was originally one cop said I could theoretically be charged with B&E...although all I did was climb through an already open window.
