| | | today a buddy and i were caught in this small alcove that was fenced off (we were outside of the fence) that led to the basement of a parking garage at and abandoned hospital/psych ward, the cop took our info and looked at our id's and all that. if we were not breaking the law then why did he do that?

| | | I would surmise that it was in the event that a crime had been committed or was going to be committed. If he had simply let you go only to find out after the fact that an arson had occured minutes earlier, he'd be regretting not taking your information. I was stopped once while walking back from the store. A car had been stolen not too far from my home. The officer asked to see my ID and bottom of my shoes, which I showed him, but they weren't the footprints he was looking for (it was winter). I got stopped a second time, and I told them that I'd already been stopped just moments earlier. The first officer radioed, "He's okay" and they let me go. Now if it came to be later on that they were the shoes (although he'd already checked... but for sake of argument) he would want to have a name to go with the person. | | | It's also a deterrent for some people. They worry they might get flagged on the system if caught again so it can put these people off.

| | | Because that's what cops do. He had you on trespassing by the sound of it, but that would just be a pain in the ass and eat up the rest of his shift. So he took your info. If anything happens to that hospital (think fires), expect a call from the PD.

It kinda depends on what hospital/psych ward it was. If it was some place like Childrens Hospital they take it pretty seriously but if it was an older more run down one it was probably a scare tactic. PM me with what hospital it was please I would love to go check it out!!

| | | Because you let him. He had no legal basis to do that, assuming it wasn't posted no-trespassing. (Unless you are driving, or arrested, you never have to provide ID). That said, the last three times a cop wanted my ID "just to check the details" / to copy the name to his logbook I complied. It's easier not to have them pissed of at you, and as long as nothing goes missing / catches on fire in the next week or two, you'll be forgotten about, and probably not even in any permanent records.

Hmmmmm let me think about it...nope still not a cop maybe for haloween...nope not even then lol, he posted pics of the place on another thread and if I was a cop I know where its at and could have busted him. Its a well patroled place or at least used to be so if he does get busted its for lack of checking the place out well enough. Its across the street from the main hospital here in englewood. But hey good luck to ya just keep your eyes open.

| | | Yeah, in most states you're not required to show ID if a cop stops you on the street (you are for traffic stops, obviously, but if you're both on the street then he can't make you do anything). I'd check your state law to be sure, but for the most part I wouldn't worry. This is one of the few times where I grant a concession to a cop that I don't have to. It makes them feel better without getting me in trouble.

| | | Sort of, yes and maybe no. How about we know what we're talking about before dishing out legal advice. OK? Thanks. In Hiibel v. Sixth Judicial District Court of Nevada, http://www.google....rB_7WMBzMI-4E-aFVA SCOTUS upheld state laws requiring citizens to disclose their identity to police when officers have "reasonable suspicion" to believe criminal activity may be taking place. We call these "stop-and-identify" laws - they permit police to arrest criminal suspects who refuse to identify themselves. As of 2008, 24 states had stop-and-identify laws. http://en.wikipedi....E2.80.9D_statutes Colorado is one. http://www.dvmen.org/dv-177.htm#16-3-103 It does not matter what your state's law is, cops can't compel you to identify yourself without "reasonable suspicion" to believe you're involved in some sort of criminal activity.
You were somewhere you weren't supposed to be - so they have "reasonable suspicion" to conclude you're involved in some sort of criminal activity.

They say "you can't judge a book by its cover!" I say "YES you can, if the cover has a girl on it with a cock in her mouth, its PORN!" if she's 18 and the cock is black, its GREAT porn! |

"Supposed to" isn't a legal term... They were legally allowed to be where they were, so they probably could have not given their names if they wanted to. If you aren't sure if you are required to show ID, you can always ask if you are free to leave / if they are detaining you. (I just read Devil's links... which say the same thing). And no, lying to cops is a bad idea. It's much much safer to say nothing. Or something completely innocent and off-topic, but be careful it doesn't incriminate you some other way. If you are afraid of it looking suspicious that you don't want to say anything, just tell them your father / lawyer / ron paul told you never to talk to cops, ever.
