Cononish Gold mine is in the hills North of Loch Lomond several miles along a quiet glen, this small trial mine never produced much gold, but it may reopen soon...

Very nice photos! It does look recently active. I like how mine exploring is a semi-legit hobby in the UK. Over in the US it's looked down on by "real" cave explorers and considered dangerously illegal by everyone else

Turn off the internet and go play outside.

It's a little gold mine in there!!

We all had ostriches. My dad had an ostrich farm! I remember one day someone came in and said the high altitude bombing of Kosovo had been a limited success, so we all went out and celebrated… by killing an ostrich and boiling it in kiwi fruit.

That's pretty much the situation here too

Trespass here isn't usually a criminal offence, and we do have right-to-roam legislation - though you'd have fun trying to argue that applied to a mine...

The wording 'or man made structure' in the act should have you covered on that one I think matey.

Yup, I don't think it'd ever be possible to argue Right to Roam for urbex, except perhaps on the way to a location...

“cultural heritage” includes structures and other remains resulting from human activity of all periods, traditions, ways of life and the historic, artistic and literary associations of people, places and landscapes;"

Section 32, Land Reform (Scotland) Act 2003.

My lawyers' view was that this would extend to Asylums, Industrial Ruins, Institutional settings and really pretty much anything out of use and of interest.

Would the judge agree?? Not sure, as I don't think anything exactly like this has ever made it all the way through court. CPS usually drop Urbex related charges* very quickly; given the near-certainty they'd loose.

Chris...

The legal advice I got was that the problem rests with the concept of "out of use" - it could be argued (and probably would, by site owners) that lots of sites are not out of use, they're awaiting a new use, undergoing remediation or recycling, or something similar. Her opinion was that anywhere that still had any security measures would be looked on as not "out of use".

I guess you pays your lawyer and takes your choice

Really, though, I don't think it matters all that much whether we explore completely legally via Right to Roam, or almost completely legally via civil trespass. Either way, it's possible that the police could kick up and arrest you.

I never break and enter or steal, though - what's the point, when there's so much stuff about that it's possible to get under, into or on top of, with a bit of thought? My to-do list is long enough already...

The problem land owners have with trying to enforce Civil Trespass here is they need to PROVE what you did harmed them or their business in some major and tangible way.

For what we do, they wouldn't even have the start of a case I don't think.

Yeah, always - you just gotta meet that one polis who's having a bad day I suppose. I wouldn't think the CPS would take anything like that any further though.

Having said that, in every dealing I've ever had with the Police here they have been sweet as a nut; so I can't really complain!

No I'm with you matey; I've yet to even SEE a place where you would need to up here... Big chains, welded sheet steel on the windows, bricked up doors and yet they leave an open skylight on a low roof or an unlocked door at the front; it's the Scottish Way(tm)!!

/That or Pikies unlock the place for you; both work.

Only problems I ever had with the police were over ROF Bishopton, and to be honest that's perfectly understandable. Serves me right - and it was all dropped anyway, so no harm done...

Ben - when did you take those (pretty damn good!) photos? The yellow trolley has been moved past the gate and all the tubs tipped over. Has there been activity on site?

These were from last June - there was a news report more recently that they were doing some more prospecting in there, and there was a new planning application or something as well.

I came.

The Durango '95 purred away a real horrowshow - a nice, warm vibraty feeling all through your guttiwuts. And soon it was trees and dark, my brothers, with real country dark.
