Do any of you carry while exploring? NOW WITH 100% MOAR POLL

I figured this was better suited here than in the Rookie forum, as Texas, OK, and LA share a gun culture seldom understood by a lot of the country.

I've seen the argument raised on the site that it would lead to trouble with LE, but I think it's just the opposite; when you notify the officer and hand him/her your CHL they know immediately that you are not mentally deficient, and have no criminal record to speak of.

Eta: and Captain Slow.s latest post shows me that while out exploring, I will not be leaving my pistol at home or in the car..

I have my concealed permit, but typically leave my handgun in the vehicle, along with the shotgun. As you say with this area of the country, personal weapons are a way of life. I'm far from an avid collector or anything, but I still have 10 or so weapons. I've had the weapon in the car a couple of times when pulled over for speeding violations and just told the officer it was there and showed him my permit and they were cool with it.

Where I'm exploring, I'm more worried about snakes and rabid skunks than meth labs, so my club and machete are all I usually carry. In a larger metro area, I'd have to say I probably would, as you never know what you'll come across.

Sidenote:.... and I'm NEVER going exploring with Capt. Slow, lol.

Snakes are definitely a concern here, I was thinking a .38 with a few snake shot and a few JHPs...there is always a long gun in my truck, but one on the hip beats two in the truck..if I wind up close enough to a snake to use an edged weapon (short of a broad sword), then I've done something wrong and he and I are both likely about to learn a painful lesson

And so when man and horse go down

sometimes -- but usually not. i think there's an important litmus test in this. if someone thinks they NEED to be carrying, i question whether they are a danger to themselves and those around them... people thinking they will NEED a weapon tend to create the situations where weapons are needed. if someone carries just as a reasonable precaution, particularly in rural areas, or carries out of habit, i don't have a problem with it.

i have a CPL and on the rare occasion i've been pulled over while carrying, my declaration and presentation of the CPL has always resulted in being let go as a professional courtesy. i wonder, though, if that same kind of courtesy would ever extend to a LEO who is on the scene because of my UE'ing. i kind of doubt it.

I've got an easy burton, does that count? As I said in the op, is really a region specific question, which is why I posted in here..

As for that specific thread, if the op isa worried about being disarmed, I'd recommends some good training. The risk is ALWAYS there, but with proper training, it can be minimized. I don't carry a sidearm because I think it's cool, I carry one because it's become an extension of my body, and I have a wife and 2 y/o son to protect. If I'm wearing pants, I'm carrying a firearm (except in the few places I legally cannot)

It's not that region specific. If you feel you need a gun in a location, you shouldn't be there as it's not worth the risk. So what if you carry it around and maybe risk a ticket for it, but worse, what if you have to use it? Do you REALLY think the law is going to look down happily on your for killing someone in an abandonded building, even if it was technically self defense?

The part that you're leaving out is that I believe most of the time when we are "exploring," we are technically committing the tort of trespass. Legally carrying a concealed or open-carry firearm can turn what may otherwise have been a civil-infraction/class-B misdemeanor into a firearms-related felony when you carry said-firearm into a place you do not have a right to be in.

Having said that, YES, on rare occasions, I will CCW when the threat-analysis I do on a target location indicates there is a greater risk to my safety by not having a firearm than there is to my liberty (liklihood of police detection & detention).

I did it a few months ago at an old military site out in the middle of nowhere that I had official permission to visit, & planned on documenting over the course of half a day. The site is highly vandalized & there was a large risk of close-quarters contact with squatters/druggies.

The site is in California, so while *outside* of the dozens of structures, I did California's BS 'Open Carry' -- pistol was unloaded in a visible holster, with a full 10-round magazine in a holder.

But as soon as I'd step-foot into one of the buildings, I disregarded the stupid law in order to improve my personal safety, and inserted the magazine & chambered a round (I also announced my presence on a military-history mission & asked anyone inside to sound-off). Immediately prior to exiting each building, I'd go cold & extract the magazine, just in-case the po-po was waiting for me outside. I knew po-po wouldn't be stupid enough to silently enter a building & look for me.

Worked fine, but in their infinite liberal stupidity, looks like California will be getting rid of their Open-Carry law.

I guess I wasn't really clear. I carry a handgun everywhere, is there any compelling reason not to do so while exploring that you guys/gals have come across.

It is region specific as, not only is it perfectly legal in some regions, out is also very common, I.e. Texas..

It's legal to carry it sure, but it's a technicality. If you get caught in an abandoned building armed with a camera and a small knife or wasp spray, you will get simple trespass so long as you're not doing something stupid like spray painting or smoking pot. If you have a handgun on you though, it automatically bumps the charge up to criminal trespass, no matter what you are doing, and that is a much bigger fine and stays on your record.

and besides, just because you CAN have a gun doesn't mean you SHOULD. In this case, there really is no real reason to carry a gun. Any scenario you can give me can be handled better without the gun, bar none. There are better ways to stroke your ego than to carry around a gun in an abandoned building.

And, to be clear, I own guns and take them to the range and carry them elsewhere, so it's not like I'm some whining gun controlling liberal.

There is no such thing as simple trespass in the Tx PC. The only crime is criminal trespass. You can be 'trespassed' from a location, think of it as a warning, if you come back, you whil be charged. Whether you are legally carrying a handgun has nothing to do with it.My mistake, this is incorrect, Criminal Trespass is a Class B misdemeanor in TX, Class A if you are carrying a deadly weapon I would bet you that the pocket knife you carry is illegal in my AO...

As for why I carry, well, I have no real concern for your thoughts there, I can give you scenarios any time you'd like that would be handled best with a gun..

For the sake of the thread, so for there are
1-gun in truck
1-gun on person case by case
2-no guns

eta- I find that arguing the legal semantics of this is somewhat ironic, I merely asked the question wondering whether those in this community did or didn't carry. For your reading pleasure, I'd point you towards TXPC 30.05 Trespass is already going to be a Class A if it is in a habitation or dwelling, so I guess the handgun would be a freebie at that point lol

-exactly

I dont carry anything more than a pocketknife and have never needed anything more. do I pickup the occasional conduit piping for extra protection? Sure. But I cant think of a time where a gun was needed.

Of the two times that I have been "caught" (both in well abandoned houses), the land owner was with gun in hand. If they saw me carrying, it's a safe bet they would have fired first then sorted out the mess. No sense taking the risk on someone carrying a gun onto / into their property without permission. But then again it's the Mid[wild]west here.

If you think there's a need for a gun, really weigh the risk of what happens if it gets lost? If someone commits a felony with it and it's registered to you, that'll be an impressive mess to explain. Or if you do come into contact with people that have all intent to harm you, what happens if they overtake you?

Seems like if you need to bring a gun into a place you didn't do your homework, or dont well enough understand what exploring the structure entails. Observation is key.

Really, do what you will, it's you're judgement.

Hmm....seems I grabbed the wrong copy of the PC off my shelf...the latest version of the PC states that if you are being charged with a Class A Criminal Trespass due to carrying a deadly weapon, it is a defense to prosecution that you were carrying concealed under authority of the government code. Basically, it seems that this section of the Texas PC is an effin mess.

-CT is a Class B misdemeanor
-unless committed in a habitation or shelter center or superfund site or while carrying a deadly weapon, then it is a Class A misdemeanor

-CT is a Class C misdemeanor if committed on the agricultural land of another or if you are apprehended within 100 feet of the boundary thereof

Also, note that the Texas penal code defines a deadly weapon as: a firearm or "(B anything that in the manner of its use or intended use is capable of causing death or serious bodily injury." Meaning tripods, clubs, pipes, knives, et. al.

I forgot what a clusterfuck the Texas PC was....of further note, this is just the state statute, there are also municipal codes to contend with (what I referenced when I said that your pocket knives are probably illegal in San Antonio. I found out the hard way, shortly after being medevacced here, that San Antonio city ordinance makes lock-blade knives illegal (how's that for idiocy, I can carry a concealed handgun, or a fixed blade up to 5", but not a pocket knife)

Firearms- no. I have thought about it, but I prefer to not be charged with a felony should I be arrested. I do have weapons, and mace, but I do not bring in a firearm.
