| | | Posted by vov35 as I recall breaking merely refers to the perimeter. also, does anyone know where I can find MD's code for B&E? I need to get an idea of what exactly I'm defending myself against. Thanks.

From what I've been able to find online, B&E in Maryland is treated as fourth degree burglary.
Definitions (Only relevant ones kept here):
§ 6-201. Definitions. (a) In general.- In this subtitle the following words have the meanings indicated. (b) Break.- "Break" retains its judicially determined meaning except to the extent that its meaning is expressly or impliedly changed in this subtitle. (f) Enter.- "Enter" retains its judicially determined meaning except to the extent that its meaning is expressly or impliedly changed in this subtitle. (h) Storehouse.- (1) "Storehouse" retains its judicially determined meaning. (2) "Storehouse" includes: (i) a building or other construction, or a watercraft; (ii) a barn, stable, pier, wharf, and any facility attached to a pier or wharf; (iii) a storeroom or public building; and (iv) a trailer, aircraft, vessel, or railroad car.
[An. Code 1957, art. 27, § 28; 2002, ch. 26, § 2; 2003, ch. 17.]
|
Specifics (again, only relevant stuff intact here):
§ 6-205. Burglary in the fourth degree. (b) Prohibited - Breaking and entering storehouse.- A person may not break and enter the storehouse of another. (e) Penalty.- A person who violates this section is guilty of the misdemeanor of burglary in the fourth degree and on conviction is subject to imprisonment not exceeding 3 years. [An. Code 1957, art. 27, § 32; 2002, ch. 26, § 2.]

From: http://michie.lexi...in-h.htm&cp=mdcode Technically speaking, they've got you assuming the "judicially determined" meanings of break and enter are similar in Maryland to what I quoted in my previous post. I'd definitely offer to plead guilty to the lesser charge of trespassing, though. Juvenile hi jinks and all. . . Good luck, either way.

Sorry, I didn't realize the link wouldn't take you right to the info. It's found under: CRIMINAL LAW > TITLE 6. CRIMES AGAINST PROPERTY > SUBTITLE 2. BURGLARY AND RELATED CRIMES I should point out that I'm not a lawyer, but studied a fair bit of law for my Computer Security diploma. Occasionally it comes in handy in UE situations. ;)

If you keep pushing limits it's not a case of if but when you'll get caught.

No matter what, trust only your lawyer. The prosecutor is not you friend, the cops are not your friends, the judge is not your friend. Don't admit anything to any of these people. If you end up having to go to the initial hearing just plead not guilty and ask for a public defender if you need one. Most US states can charge someone with burglary even if they did not break into a building. Even being in an abandoned building can result in a burglary charge. Lying to police is a bad idea because they can then charge you with obstruction of justice if they can prove you lied, which is very easy to do. The best thing to do if the cops are being dicks is to keep your mouth shut and wait for a lawyer.

| | | Posted by TuxThePenguin Exactly. If you didn't break anything to get in, the worst they could legally charge you with is trespassing.

In MD breaking OR entering counts as B&E. My advice: beg for mercy without admitting anything they haven't already proven.
For the future: never park (your bike) near the target, never trust cops, run faster, etc etc.
