Overgrown No Trespassing Signs

The short version:

If a No Trespassing sign is blocked by sprawling vegetation, and you really can't see it unless you go looking for it, would "I saw no 'no trespassing' signs", be a valid excuse?

The long version:

I've had my eye on a pretty interesting house for a long time now. I was never really sure if it was abandoned or not (fading paint, vines growing up to the roof, water stains/damage, never a car in the driveway, but otherwise in ok shape) until recently. I didn't want to get too close until I was sure because the house sits right on a very busy road with a gas station across the street. Didn't really want to risk it on a house, ya know? Before the leaves came out this spring, they put up a small, but valid No Trespassing sign. That was my validation that the house is indeed abandoned. But now, those vines I mentioned earlier have bloomed and are covering up said sign. So, if I went in, could I use the whole "Duhrr I didn't see any sign" as an excuse?

At least in Tennessee, you're still trespassing, and can be prosecuted for it, even if there isn't a No Trespassing sign. I'm not sure what the laws in Maine are like.

Yes, you could use that as an excuse. It might work, it might not.

Case in point. One time, I ran into a property owner after having already encountered numerous large no trespassing signs. I was on his propery at the time. I waved my camera/tripod at him and said hello. He told me he would leave the gate open for me but to please close it when I left. Another time, at a different site, a property owner/manager got in my face for simply standing on a public street with a camera near his buildings. There were no signs to be seen anywhere.

So. You never know. It certainly doesn't hurt that the sign is mostly obscured.

Dress up in really raggedy clothes and just walk in. If you get caught or cops called, well you are a squatter, odds are 90% they would let you go ... seeing as it would cost more than it's worth to prosecute.

If you find it is indeed abandoned, return later with your dSLR.

agreed. In this city the police go after them whenever possible (for some strange reason) so it definitely wouldn't work here

I'd say go for it and use it as an excuse. I've been places where there were blatant "no trespassing" signs that I legitimately didn't see, and I was let go with only a warning not to come back. I think you should be fine.

Personally I have never found pleading ignorance to be a great excuse.. it's likely that no matter what the cop says it's still trespassing by the letter of the law, I'd figure out a better excuse.. I think at least some cops use common sense.. Personally if I was a cop and I busted a bunch of people in an abandon building or site (anywhere that any ounce of common sense says your not "suppose to be") I think I would be more likely to do something if they tried to plead ignorance.. It's one of those things thats borderline insulting to the person your trying to bullshit.. your better off just being respectful and explain whatever yer doing (granted theres a fair amount of leeway you can use in the explanation).. god knows I have use some retarded excuses but one of them has never been "gee I didn't know I wasn't suppose to hop a 12 ft fence and jump through a second story window because all the doors are padlocked or boarded up"
But thats just me..

I've been exploring with friend and one of them will point out that there are trespassing signs. I just say "where? I can't see any." Ignoring them isn't foolproof, but I've used it effectively

Behind every mistake, there is a lesson.

I'm just not that great at learning them!
