| | | If there's no No Trespassing sign, should I be ok < on 5/5/2010 4:13 PM >
| | | I want to go on my first Urban Exploration this weekend on a place I have found a couple of weeks ago. There's an old house almost cover by trees, and behind it a fence and some building that were used by a company. On the fence there is some No Trespassing signs, but for the house there is nothing, and the house doesn't seems to be boarded up, so it will be easy to enter in the house. So since there is no sign on the house itself, do you think there will be any problem if I get caught inside the house ?

| | | It really just depends on how hardcore the owners are, but from the way you describe it, doesn't really sound like anyone would care. If a cop sees you, he may question you... but in my experience with places like this, they see I mean no harm and usually just tell me to leave or are surprised at my hobby and become curious and ask to see pics and then I'm on my way. Keep in mind though that every cop is different and so are state laws. If you are really concerened about being caught, look up the trespassing laws for your area and let that be one of your deciding factors. Happy exploring!

If the property is marked, it doesn't matter where on the property you're caught (including inside).

Take one of the signs off the fence and put it on the house, then you should be good.

| | | Yea, you could take the sign off, and walk around with it facing you. So if you get caught, you can say you never passed the sign.... But like Yokes says, if its on the boarder of the property, its for the entire property (house included).

| | | If the place that you are at is forested, say you were taking a hike and stumbled across the property you are at (worked for me a few times). If it is more in an urban area then you could say you didn't see any signs but depending on the cop/security officer that caught you it may not fly. Other than that your screwed, just dont point your flashlights out any windows!!!

Use gloves, bring lots of lock picking tools, and make sure you have a knife to protect yourself, and wear lots of dark clothing. A crowbar is a VERY good idea too .... best way to not get caught.

| | | Pull the tax maps to see if the house is on the same property as the fenced in area. Also check your local laws for how far apart "No trespassing" signs have to be, for example in Vermont they have to be very close together and renewed and dated... IMO a deliberate hassle to landowners to make them give up and allow hunters etc.

| | | I have a question if someone could help. I'm not very familiar with breaking and entering laws so I have a couple questions, first do they vary by state? And I found an old abandoned hospital right in the middle of a town. The entire place is boarded up but I found one loose bored on a bottom floor window I could crawl through but if I were caught which I think is highly likely due to the location would it be considered breaking and entering because I pulled the board off to get in?

Yes the laws vary by state but if you enter the building it depends on how nice the cop is and what you will get charged with. I like the "I'm an amateur photographer just trying to get some good pictures" excuse. Any-hoo if you have any more Q's P.M. me with your state and your location and I can look up the laws for you.

| | | Laws may be explicit, but law enforcement deals in shades of grey. It doesn't matter how strict or unstrict the law is, if it's serious in the books but you're respectful you're off the hook; if it's nothing really and you're a dick about it, you're going for a ride.

| | | To be honest, as a retired law enforcement officer, I have never placed anyone under arrest for simply trespassing. The laws (especially in our state) are vague in what constitutes trespassing vs. simply wandering on to someone's property. I have issued numerous citations for trespassing, but these were for people who were actively inside of a building creating problems (drugs, etc) or vandalizing. We have several abandoned structures in our country (a hospital, two motels, houses, etc), and I used to see people wandering in to them all of the time. I never made a big deal out of it, neither did the people involved. In 99.9% of cases it ended with "Be safe, have a good night." To summarize, as long as you are respectful and not breaking any major laws, most decent officers aren't going to give you a hard time. Especially not the ones around here, as most of us have been in and out of those buildings a time or ten.

Well I've been caught trespassing and as long as I'm not doing anything bad the cops just tell me how stupid I am because it's a dangerous place and tell me to go home. But the city that this place is in has a lot of gang activity there and most of the cops are dicks thats the only reason I'm so worried. I was thinking of telling the cop I followed a cat into the building trying to save it. That usually works for me. I just don't want a breaking and entering charge. Thanks for the help though!
