Police tutorial about 'Terry' Stops -- consentual dialog vs investigatory detainment vs arrest

I'm not anti-police, but I am a fan of knowing my rights when having an encounter with po-po! Keep in-mind this article focuses on Terry stops, & there's a BIG difference between that & popo observing us trespassing...

If you're basically busted, being respectful & cooperative can go a long way, though you should be careful to not actually confess knowingly committing a crime.

On the other hand, stating "Officer, am I being detained?" before saying *anything* else can be even better, assuming you calmly walk-away without making any statements if the answer to your question is "no."

I think I understand. But as pertains to trespassing how can the officer prove you were doing it? other than your own confession. Are the police allowed to seize your camera and look at the pictures? I often wondered this.

No, the police cannot seize your camera. In order to be able to do that, you would have to be charged with a crime (or at least have probable cause to do so) and a search warrant issued. The only other way they would be able to look at it is if you have them permission.

As far as whether they know you have been trespassing or not goes to where you were when they made contact with you. Never just give up information. Feel out the officer they same way they will to you. Figure out how much they know, and go from there, yet stay respectful. You don't want to give them a reason to look further into the situation.

I would be careful about straight-up asking if you're being detained. Yes, that's the blunt way to do it, but you may come across that one cop that asks is there a reason you should be? Like it's been said multiple times, knowing the law while doing UE is always a good practice.
