Dorea Asylum
< on 2/24/2015 8:57 PM >

Thinking of going here in the next little bit.

http://www.urbexpl...ute-tribute-horror

Looks very interesting. My main question is if anyone has any experience there? What to look for but more importantly the land owner. We plan to go in the day to prevent criminal trespassing, but I found a forum post about him detaining people and other comments about him showing up and aggressively asking people to leave. But then people saying they have gone multiple times with no issues.

Anyone ever had an experience here?

Not sure how going in the day prevents criminal trespassing. I thought laws were 24/7 ;)

From 9PM to 6AM in canada trespassing becomes a criminal code violation on a federal level. During the day its a provincial matter and is less harsh, doesn't come with a criminal record on the nationwide level. In quebec the trespassing laws are even more vague as they are not strictly defined and common law precedent is used. Based on my research is looks like the max is around a $250 fine. It carries the same effect as a parking ticket though.

This is the first I have ever heard anything like this. My understanding is trespassing is only based on provincial laws. In fact here in Saskatchewan we didn't even have a trespassing law until 2009. I know that when we are talking about Federal Property then the laws may change but I believe that is only DND property that you could receive a charge under federal jurisdiction. Correct me if I am wrong and I would love to see a link to what you are quoting if you have something.

To clarify, I did not mean to imply that it is automatically a criminal offence if you are caught at night, but depending on the situation, it could end up as one.

Some quick googles found this:

http://en.wikibook...espassing_at_Night

http://ambientligh...law/criminal-code/

http://laws-lois.j...6/section-177.html

So it is defined as "prowling", implying more aggressive intent, but its vague enough that going around with a camera could qualify.

This is also in the UER how-to:
http://www.uer.ca/...d=3&threadid=66590

______
7) Is trespassing a criminal offence? Will I have a criminal record?

No. Trespassing falls under the Provincial Offences Act, which means that it falls under provincial legislation. There is no criminal record involved. It is quite similar to receiving a speeding ticket except in that case it would be a Highway Traffic Act offence.

You should know however that it could be a crime if you trespass by night (9pm-6am):

Section 177 of the Criminal Code of Canada states that:

177. Every one who, without lawful excuse, the proof of which lies on him, loiters or prowls at night on the property of another person near a dwelling-house situated on that property is guilty of an offence punishable on summary conviction. [R.S., c.C-34, s.173.]

Translation: If you have an excuse, the burden of which can be proven, such as your missing dog running out from the bushes, you are likely to be let go. If you are caught in the bushes of an occupied house without a legitimate reason, you are in serious trouble.

Note that this must occur at night, not the daytime.

I wrote a lengthy guide on this subject. It may be found here.

The key term here is "dwelling house". A vacant asylum is not the same as your neighbor's backyard. The criminal offence is only applicable to a dwelling house. Criminal charges could still be filed if there was an indictable offence you intended to commit but for photography alone, it would amount to a P.O.N. being issued.

That's the main article I pulled from actually, but thank you for clarifying the 'dwelling aspect'. Maybe I will go later, may be easier to avoid being seen if we can get through the field without flashlights......

I actually ended up going. It was worth the trip because I'm not too far from it. It was neat and I'm glad I went. Was def surprised at how much is gone now but I DID make friends with a bird. He flew into a wall and got dizzy so I moved him off the floor.

I was a bit bummed with the fact that most of the basement was flooded with a good 3 feet of water but it was neat. Glad I went once.
