Do nothing to make him angry, say nothing if you can help it and if necessary...find yourself a good lawyer. That positive test is going to make whoever your judge is very very angry. I can almost bet on it. He could make your situation worse, hopefully not, but it could get much much worse. They didn't give you a conditional license? In NY, in certain circumstances, you can get a "conditional" driver's license while doing your suspension time for DWI. You probably won't get full privileges restored any time soon, but if there is a conditional program, you might get that, even with the failed drug test. My advice...stop smoking until you get this conviction cleared. I know it's hard, but man, if you want your license back, get your shit together for the next few months and quit smoking till you get everything back, then...don't get caught.
