That's a tutorial??? I can't believe the excremental waste that ExKa|iBuR is spewing forth under the guise of some sort of authority. I won't get on my soapbox her but if he's an actual law enforcement officer of some sort, he's dangerous and it's gonna cost his agency some big money on a law suit some day.

Not withstanding his "opinions", what is it that leads you to believe those statements aren't true? It matches most of the material that i've found to be true in the past.

the tutorial is by the original poster who does appear to be an attorney

and it appears to me to be well written and accurate

I dont give too much credence to stuff written by excaliber and other uer experts

if I even read it at all

theres about as many "experts" on the law around here as there are body orifices

Internet advice = 1 grain of salt

The thing that scares me the most about Excalibur is that he says the cops can just smash your camera they goes on to say good luck trying to prove it in court that they did it. If he's really a police officer, he's the bad kind that they make B movies about.

obviously he works in a department that has no city attorney (or one that dont talk to the PD command)

maybe 20 years ago out in the sticks or NYC maybe but I cant imagine that today least not in a major department

true story no smashed camera but same mindset

25 years ago a buddy and me were stopped and searched while enroute to a camping / fishing / shooting weekend trip (no probable cause either)

older cop took my tricked out Colt Gold Cup out of my range bag and shoved it under his belt while he went back to his car to run our drivers licenses

younger cop though took my buddy's Ruger Super Blackhawk and pitched it onto the ground! scratched the Hell out of it and he got pissed (my bud) and protested like WTF you do that for? the young cop said: its just a gun you shouldnt be allowed to own a gun anyway!

I was horrified I didnt actually see him toss it but I heard it hit the shoulder of the road I thought my bud was going to have a stroke

then the younger cop asked if we had any more guns and I felt compelled to tell him we did so he wanted us to open the trunk and he started dragging out our rifles and and other gear looking at them he got my Mini-14 out and said whats this for? why do you need this are youze guys bank robbers or something?

he was clearly from up north somewhere and didnt understand why us poor dumb rednecks we even allowed to own firearms

I respect lawmen a lot but that day I really wanted to give this young punk an education (I was young too then btw) so in my best southern drawl I said weeer goin a campin, never know when your gonna run into some niggers or Meskins out here, and I thought the punk cop was going to shit! he turned red and went back and told the older cop what I had said, just about then the older one brought our DLs back handed me my .45, butt first like a gentleman but still loaded, and said you boys stay out of trouble now

the young cop was very exasperated he wanted to lock us up for something, anything, my bud was still standing there fuming and the older cops said, wheres his gun? give it back to him, young cop says its down there pointing to the side of the road, old cop said get in the car and told my bud sorry you can pick your pistol up now turned his back to us and got in the car him and his rookie had some words I think

anyway not your textbook police academy traffic stop, both our handguns were loaded (only a real moron would throw one down like that) the older cop recognized we were no threat after seeing our other gear he knew we were just sportsmen and not bank robbers but I think the racial remarks made to the young yankee cop were what finally let him know we were O-K guys

oh yeah, the Blackhawk it was badly scraped up we cleaned it up a bit but it always bore the scars of this encounter with young Johnny Law whose badge weighed more then his balls

about 25 or 27 years ago man I'll never forget that young cop Id like to meet him again!

Property is property regardless if it is a gun, a camera, a car, a TV or a Ming vase.
Having a badge does not give you the right to destroy it.
