| | | So, I’ve found a real cool tunnel. I didn’t see any “no trespassing” signs, but it was obvious that I shouldn’t have been there. If I’m not jumping a fence, stretching over barbed wire, or going beyond a “no trespassing” sign; is it legal? Also, if a worst-case scenario situation arises, what would/could the cops even do? I ask these questions because I’ve been to jail and I’d hate to go back just because I wanted to explore.

If it is public land, you are free to walk all over it as much as you please.

I agree, When any member of authority Be kind, gentle, but firm. Always agree with the cops when your somewhere you shouldn't be, Just like if you get pulled over ALways refer to them as Officer Never Dude or man, or by just they're name tag. Always Always make them feel comfortable about you because if you act nervous or like your hiding something you'll get in more trouble especially if they run you and find out you have a criminal record. If authorities stop you and attempt to search you or arrest you then you need to stand up for your personal rights. They have no probable cause to search you as you haven't broken any posted rules. Play innocent. Tell them you thought it was okay to enter the tunnel because you didn't see any signs saying otherwise. Apologize and leave before things get ugly.

It's from Predator's Approach but is also, I think, one of the early mottoes of the cave clan. "We demand public access to public works!" Drains are a public work and therefore, logically, should be open to the public if they knowingly accept the risks involved and wish to enter them. If they are not posted or your city/state doesn't have specific statues on them: there should be nothing illegal about entering them. Now you might still get arrested because cops can and will do what they want but I don't think it will hold up on court. If you're not being a dickhead and the cop isn't either you probably won't be arrested or ticketed in the first place. And to the OP people have been exploring under the twin cities longer than you've been alive. They have some of the largest and best drains in the country. I generally agree that we should have "public access to public works". I can see things for which there are reasonable exceptions, but I see exceptions as being appropriate only for unreasonable access. I don't think I should be allowed to take a nap on the couch in the City Manager's office, just because it was paid for with tax dollars. But I do think we should be allowed to see and use 99% of what we paid for. It used to be that the reason they would deny access to some public works was their fear of people getting hurt. Or more bluntly, their fear of lawsuites. In those days, it was common to get a warning. "You can't be here; you might get hurt and we can't incur the liability". There is some fear that "terrorists are likely to target our transportation infrastructure". (Personally, I don't think that is true. I think terrorists want to maximize loss of human life.) But that fear has resulted in tightened security on railroads (generally private property) and under bridges. The state DOT now posts "No Trespassing" signs under our bridges, including ones which have a walking/bicycle path under them! I have noticed a trend of "No trespassing" signs that they really don't mean to enforce as such. Not only has the state placed them on the public bike path, 7-Eleven has them on their front doors! In the video I linked to, the TV reporter makes a big deal about how the storm drains go within "a few hundred feet" of potential targets for terrorists. She doesn't say that public streets are much closer and sidewalks closer still. Nor does ahe mention that anyone can purchase a ticket and actually walk inside these "targets".
