|  | | | Hi everyone... a friend of mine got busted at Gates. He got charged with 2nd degree burglary. (Which is a felony by the way.)
In Colorado, 2nd degree burglary qualifies as "entering a building [with intent to commit a crime]".
So he just got out of jail. His bail was set to $5000. His friend is still in there, and this happened on Tuesday.
He had in his possession a old switch panel. I would assume that it's theft & trespassing but he apparently had "intent" according to them.
Just something to keep in mind if you're thinking about going.

Because it's going to be landfill doesn't really matter to the police.
They see a guy carrying an old switch panel who's currently trespassing and arrest him with intent to break the law while unlawfully entering a premises.
Again, how does this not sound like second degree burglary?

I'm saying it's wrong to charge him with a felony for something that was worthless to the owner. He could have just as easily been charged with theft and trespassing but they decided to be hardasses about it. I don't think it was any reason to be jailed by any means.

I'm not sure about Colorado, but usually it needs to be more than $1000 to get fellony cahrges. They always go high and let you plead down. He needs to fight it, it will be an easy 'win' if you want to call it that. If he talks nice and pretends like he cares, there's a chance he gets off with trespassing. You catch more flies with honey and all. But you're right Boffo, he fucked up and got caught. Lesson 1 don't get caught. Lesson 2 play dumb and innocent. lesson 3 take your fuckin medicine.

If it is total BS from some jackass cop that used to get beat up in high school and now has a badge (there are some) the DA will throw it out if he thinks it is a waste of time and money to fight it with little chance of winning. After all it is just trespassing and some garbage, in a building he really doesn't have any reason to care about, not like the court house. An old missileer I know who was raised in a tradition that more often than not was rightly called SAC, once said a DA is just a lawer that couldn't make it in private practice. He's been walking that tight line since the 60's.
