Need help with SC Law

I was searching for SC Code of laws to look up the local laws regarding trespass and this is what Ive found:

SECTION 16-11-640. Unlawful entry into enclosed places. [SC ST SEC 16-11-640]

It shall be unlawful for any person not an occupant, owner or invitee to enter any private property enclosed by walls or fences with closed gates between the hours of six P.M. and six A.M. The provisions of this section shall not apply to any justifiable emergency entry or to premises which are not posted with clearly visible signs prohibiting trespass upon the enclosed premises. The provisions of this section are supplemental to existing law relating to trespass and punishment therefor.
Any person who violates the provisions of this section shall be deemed guilty of a misdemeanor and upon conviction shall be fined not less than twenty-five dollars nor more than two hundred dollars or imprisoned for not more than thirty days.

Now, I interpret this to mean that if there is no "NO TRESPASSING" sign anywhere its free reign, and any time between 6am and 6pm its free reign regardless of whether you have a sign or not. Any ideas? Help would be appreciated as I would loved to have found a nice little loophole.

Yeah, but there's this little caveat. This law is in addition to existing laws about trespassing. No loophole here.

Basically it looks like its saying even without a no trespassing sign, if you enter a place between 6pm & 6am. you are in violation of this section. This caveat is in addition to the normal trespass law which are on the books.

I agree, doesn't sound like a loophole.... wishful thinking! But thank you for the link..... I am going to study up on it right now.

No loophole, just the opposite. It says in addition to having to heed no trespassing signs you must also not breach fenced or walled off areas with closed gates that have no signage posted.

Just when I thought I was out... they pulled me back in.

Ok, I just talked to a Deputy and he said (in a nutshell) if there are signs posted youll probably go to jail. If there are no signs posted, then its taken case by case. No signs and youre destroying stuff, you go to jail, if your not vandalising then they just ask you to leave since its probably dangerous.
If the owner asks you to leave and you dont, then they take you to jail. If you leave, then they serve a something or another (I forgot) where basically if you come back, you go to jail. Obviously all cops are different, and your attitude and what you are doing will probably warrant whether or not they just tell you to leave or pick you up.
I have a city cop that we do favors for because he sends us renters and helps us out on stolen cars. Im going to talk to him next.

From what I know of the law, which isn't a great deal but I've done alot of reading about my local laws, the penalties imposed will greatly vary on numerous things (both between minor and adult and just general sentencing guidelines).

# 1 - Most important - If they charge you as an adult. It happens all the time. From what I have seen locally, if you knew what you were doing was against the law and its a serious enough crime, welcome to adulthood. For example, for trespassing, I seriously doubt they would charge you as an adult. However if you trespassed, vandalized, destroyed or stole something, well your chances got a whole lot better.

# 2 - How cooperative you are. Now this is a slippery slope so follow your own moral compass. Always show the officer respect but there are a few key things too remember. Unless you have been stone cold busted in the act, don't ever admit to any wrongdoing (What you say can and will be used...). Also, remember they cannot search you unless they have probable cause. Don't consent, ever, to a search. Make them get a warrant. Be nice but be very protective of your personal possessions. The police can charge you or let you go.. you wanna be let go. Being a prick to an officer runs the rick of having numerous charges leveled against you, whether they fit or not. The officer will charge you with violations of statues they believe you have broken and the COURT decides if you are guilty or not. So again, be nice...

# 3 - Favorite quote from the movie "The girl next door" - Was the juice worth the squeeze? In other words, do your homework, know what you're getting into. Trespassing into buildings or homes may have a noble purpose, but its still against the law and you must be prepared to face the consequences if caught.

It;s not just limited to signs, fences and closed gates/doors. I've seen states that if you cross trees that are painted with purple paint, you're trespassing.
