Trespassing Question

I read that it is only illegal (trespassing) if at one point you were told not to enter/ get access to the property which would be passed upon. My question is:

If it is marked no trespassing at the only gate to the property and you got access from a different road by walking through the woods..is it still trespassing? You wouldn't see the sign coming from that way.

Missouri trespassing laws are really hardass compared to Iowa. You can read them here, in particular 569.010, 569.140, 569.145, and 569.150.

I am not a lawyer, if you want a real legal opinion, talk to a lawyer.

To summarize, it's a class B misdemeanor for you to enter a building or any structure that is lived in, worked in, slept in, or used for gatherings that you aren't licensed or privileged to enter.

It's also a class B misdemeanor to enter property that "is fenced or otherwise enclosed in a manner designed to exclude intruders" or that is posted "in a manner reasonably likely to come to the attention of intruders". That includes property where they have put a purple mark 8 inches long, three to five feet off the ground on posts or trees, no more than 100 feet apart around the property.

It's also a class B misdemeanor to enter a school bus if you don't belong in it.

Furthermore, it is an "infraction" to unlawfully enter any property owned by another.

That argument screwed me about 8 years ago.
I was caught walking through a public park after sundown (gasp). Cops escorted me to the other end of the park to show me the sign, and wrote up a summons for park curfew and misdemeanor trespassing.
Cost me $200 altogether.

It turns out that in all trials, and hearings and what not, you are judged (unless you are mentally retarded) as if you are a reasonable person, attempting to be an unreasonable person doesn't work.

They would assume a reasonable person would understand that an abandoned house or anything else is off limits.

So thats why saying something like "I didn't know" or "I didn't see it" won't work they figure a reasonable person would know.

I am not sure if it is abandoned and there are no fences though. I would ask my law teacher but I think he is feeling pestered by all my questions concerning issues like this

when we off road or do other things in places we shouldent be (im talkeing wooded areas not buildings) our plan is always to say we didnt see the sighn. It has worked a few times, but I think it all depends on the cop, what you are doing and how you act.

I often pass "authorized personnel only" or "no trespassing" signs, but once I'm on the other side two out of three times I find another way that I could have come which wouldn't have involved passing any signs at all. I always keep careful track of these things in case I'm caught and need to explain how I got in. (They're almost like "save points" in videogames.)

Sometimes you get some really suspicious guy, or someone who's just an asshole and refueses to believe you. I was trying to find a dredge last year by following some trails into a gravel pit, and I went to the trouble of taking my bike through the snow all the way around the gate (with the only "keep out" sign) so I'd have a legitimate excuse in case someone was there. It turned out there was some old man living in a cabin in the middle of the gravel pit (very wierd) who came out to yell at me and who refused to believe my story of coming in along a snowmachine trail and being lost. He stood there staring at me for about 5 minutes after I said I was lost, I kept expecting him to whip out a sawed-off shotgun and blow me away. Eventually he yelled that I was going the wrong way and that there's no way I could have gotten there without seeing a sign, and to get the hell out of his gravel pit.

I read a post on the mailing list about someone who was actualy shot at in a similar situation. Be careful out there!

some people are assholes... sometimes pleading ignorrance or especially trying to use legal technicalities won't get you anywhere when the cops are bringing you in for tresspassing, it wouldn't stand up in court though so I'd just save the "I never saw a sign" till then... either way they're going to make you leave... hopefully nobody gets shot either

Ninj has a point here. Often if you say to a cop "oh, I came in that way, I thought this place was the back of a grocery store, I was just looking for a front entrance" or something along those lines, they'll let you off with a warning. Which when you think about it is much better than saying "I saw no sign" as though you had those very words running through your head in preperation while you were rummaging around.

Cops know when people are lying, because of how unlikely it would be. If you really didn't know you weren't supposed to be there, your first words definately wouldn't be "I didn't see any sign, there were no signs, I'M INNOCENT!".

We were just in an old hotel in the catskills in NY and there were no "no tresspass" signs. So we just avoided all the areas where the signs were. Easy enough.The golf course is active, so there were plenty of "notress" signs. Didnt'stop us from having to find our way around a bunch of fencing.

I got your tour winner right here pussies, at least he'd crash out trying.

I guess it really depends on the situation. If your on the roof of some abandon building and your reason for being up there is that you were lost and you thought you could use a phone, just isnt going to work. If your on subway tracks even though a NO ENTER sign isnt visible, its not like you can just sit there and not get in trouble. The law does have flaws, but its ultimatley up to a judge to decide how negligent you were.

Liz and I found a bathroom that connected to some interesting basements once. Unfortunately after locking the door behind us exploring for 20 minutes or so we came out of the bathroom at the same time, which seemed to confuse and upset all the people who were then standing in the main foyer of the church.

Over here in Australia you cant be charged with trespassing unless the police can prove that you did not have a "legitimate reason to enter a property"


for example: excuses such as: "My dog ran in here, i went in to get him" would be a valid excuse. the fact that the dog is not on the premises doesnt prove that what your'e saying is a lie either, the dog could have run home....

as for the hard hat and maglight "i didnt want to kill myself in the search for my dog, the building looked derelict" and "how could i see him in the dark" would work too. no matter how improbable the story is, as long as you stick to it, they won't bother taking you to court.

who knows how it is in america, canada etc it's probably fairly different
but it'd be a good idea to use this anyway.

Pretty much the law was worded this way to protect door to door vacuum cleaner salesmen, mormons, johova's witnesses and the like form prosecution by annoyed householders in a nasty mood..

after all they were only on your property to bless your house....
or rip you off- both equally legitimate excuses to enter a property.

HOWEVER once you are told you are not welcome and are to leave IF YOU EVER COME BACK YOU CAN BE CHARGED
