except this isn't an ethics thread, it's a legal thread.. which obviously if you are on someone elses property and they don't want you there your trespassing... so this is ten fold more pointless then an ethics thread as this has absolutely nothing to do with ethics and there really isn't a grey area..

They vary widely. Also note the OP (original poster) said CRIMINAL trespass. There are varying levels of trespass depending on the situation. So where I am from (Australia) you can cross someones land (trespass) and it's considered a Tort. That is a crime against a person. That is not a criminal matter, and therefore NOT criminal trespass. If the person wronged doesn't choose to press charges there is nothing the police or state can do about it. Were I to be caught upon government land (say a military base) then that is a crime against the state - criminal trespass. Now that may be completely different to where you're from, and my understanding of the law is most likely flawed. This is why you DO NOT COME TO UER FOR LEGAL ADVICE. Look it up yourself or ask a lawyer. So exploring may be criminal trespass, depending where you are and how you explore.
