| | | In Canada Break & Enter have two different and distinct meanings which are found in section 321 & 250 of the Criminal Code. 321- "Break" Means: (a) to break any part internal or external (b) to open anything that is used or intended to be used to close or to cover an internal or external opening NOTE: in the case R vs Jewell (1974) "Entry through a door open sufficiently wide enough to permit entrance to the building without further displacement of the door does *not* constitute breaking" 250 - Entrance (a) A person enters as soon as any part of his body or any part of an instrument that he uses is within any thing that is being entered and; (b) A person shall be deemed to have broken and entered if: i) he obtained entrance by a threat or artifice or by collusion with a person within or ii) he entered without lawful justification or excuse, the proof of which lies on him, by a permanent or temporary opening. Just to give some humor here: R vs Johnson (1977) "An open doorway for which a door has not yet been installed, or has been removed leading to a dwelling-house under construction is considered a temporary opening" I'm not going to get involved in the debate - but there are tons of case-law decisions for this kind of thing. Just be careful out there. You decide if what you are doing is breaking the law. Its a dual procedure offence which means it could go from 6 months in jail to 10 years in jail. Hope it wasnt too confusing

I must say that is a classy way to B&E! It nice to see that level of respect while being bad. I've consider doing the same, but decided to just forget it. There are two problems: one it takes more time, and exposure. The second problem is that it's still a felony crime. I'm not going to turn a hobby into a crime spree. Don't worry, I'm still plenty evil.

Your right in the respect to doing no damage to the structure, and that is commendable. A cop would have no choice but to arrest you if caught. The problem is that B&E is a felony, if you are convicted you are screwed. It will go on your permanent record, and haunt you for the rest of your life. A felony conviction will limit what you can do, legally in life. Not good.

That's as far as I'll go too, but only as a last resort. I used that method the last two locations I explored. I used to carry a tiny (6") pry bar, but never used it. I came close to getting caught once and figured it wasn't a good thing to be carrying around so I ditched it at the site. [last edit 5/2/2006 6:15 PM by Mr. Crafty - edited 1 times]
