Charge on carrying pepper spray in Canada

Hi everyone,
I am new to the forum and I am a new immigrant. I got a question about pepper spray... In Canada, its illegal to carry pepper spray if the container is small in size (because big size pepper spray is used against bear). How likely will the police charge you if they found those key chain size pepper spray on you? (...is that like police MUST charge every single one if they found the pepper spray...) Also, is that normally the person will go to jail on this charge?

Depends on the cop, unless you have a long list of prior convictions you do not go to jail in Canada. Its embedded in the charter of rights and freedom that the judiciary must seek all other means of punishment before incarceration. There's a a prick who just got bail for christmas who is facing a second degree murder charge in Vancouver.

I wouldn't dream of exploring without a trusty can of pepper spray...you never know when you're going to have to make an ass out of yourself!

Thankx Team Leader, I see you point... and yea I think pepper spray is a good item that can protect yourself (especially for helpless ladies) without hurting others... I am not quite understand how a pepper spray becomes a "weapon" which can be go into jail for 10 years (same level as a handgun...). For example, if you use pepper spray to protect yourself (then you run away from the attacker...) you still may be charged by the police just like you shoot people with a gun in Canada

I used to date an MP (military police) instructor, and I've seen the MP cadets get pepper sprayed with MP spray (more than 3x the active whatever than cops carry), wrestle a grown man to the ground, cuff him, put him in the car and call for backup before washing out their eyes.

Hence, I don't actually trust it as any sort of defence against a properly motivated attacker.

It's definitely easier for a girl to get away with carrying it than a guy. Just social engineer your way out of any trouble, play the helpless women and most cops get protective pretty quick.

If I were a guy I'd rely on the fact that I bought it in a legitimate store and trusted the storekeeper to know what was legal to sell and what wasn't.

Thank god you included those beautiful orbs in your mugshot. On the topic of pepperspray, it is only considered a prohibited weapon if it's used to assault someone or if you use it to commit a crime. People have actually had bad asthmatic reactions to the stuff and died. So I'd be careful with it.

I don't believe that defence will get you anywhere. To use a cliche "ignorance of the law is no excuse." You'll find yourself getting burned if you trust someone else to know the law. A good point anyway, if you do find yourself in a bad situation that you haven't properly prepared for.

Regardless, I think this is a question to ask a criminal lawyer. Getting the opinions of people not qualified and working as criminal lawyers is the worst possible way to go. No offense to anyone here, but the law can be applied differently around Canada, so call a lawyer in your applicable jurisdiction and ask the question. There are plenty who take 10 min phone calls and give free advice. I've used them plenty, and have never had a problem with getting expert opinions for no cost at all. I suggest you call a few. I have.

I know I sprays that stuff once in a desk when i was 12 cleared out the whole room everyone started coughing and the teacher knew what it was didn't even get suspended for it the kid who braught it did tho. I'd definitly agree with the fella above tho never guess or use hearsay if you are worried about something being legal/illegal.

Never even thought of taking pepper spray to a building with me I always just kind of avoided buildings in populated areas because of the thought of finding people there. I always take the kids with me to so in general try to avoid super dangerous areas. I'd be kinda worried I would end up spraying a security guard or police officer tho lol.
