Not a good idea to do. Believe high court just ruled cops can ask for id & hold you if you do not produce - also if you are caught or suspected of doing something - a response like that just about guarantees being arrested and searched. Sure your lawyer, mom & dad will bail you out but look at the hassle & $$ - would rather just try & get off w/ warning always cooperate --- nothing to hide, etc...

You'd still give him the identification, but you'd also hand him a card that states that you're fully aware of your fifth amendment rights. Every American citizen is entitled to their constitutional rights, and I don't think that saying you know and understand them puts you in any greater risk than if you let the officer call the shots. Usually, if someone is stopped and the police ask to search their person or their vehicle, and they say, "No, you need a warrant." The police never take the option of arresting that person, because it sets a legal process into motion where the state needs to appoint someone to bring formal charges against you so they can obtain a warrant and a reason to legally detain you. And on top of that, they're still not getting into your personal belongings or questioning you until you have a lawyer there. There are a lot of rights Americans have that give them power against aggressive legal policies. But when you get caught doing something illegal, obviously they aren't going to explain to you which rights and loopholes will get you out of trouble. There are a lot to just remember, and they can be complicated and confusing. I think having notes on your rights with you, while it may look incriminating, would really help a lot of people that have no idea what they're entitled to.

| | | As far as legality is concerned, I would consider it very, very unwise to carry a handgun unless you have a proper permit to carry concealed in your state. If you *are* stopped, and are caught carrying a weapon without a CWP/CCP (this includes knives over a certain size), you can be arrested on felony weapons charges. I have a small legal lockblade that is mostly utility, and I doubt i'd use it for defensive purposes. A 3D maglight is probably most effective for that.

Getting caught UE'ing with a crowbar might not be the best idea. If you're going to get caught (Now, before anyone jumps in, before RESPONSIBLE UE'ing, you must conceed at least a possibilty that you'll get caught, and thus should have a Plan B as it were), having a BNE tool might not look the best. Personally, whenever I go, I bring along my trusty Collapsable Baton, otherwise known as an extendobar, or more generally, beating stick. It serves many purposes: balance (think tight-rope, a bit of stretch, but if you're good you can pull it off ), it's a great tool for moving things that may not be safe (i.e. pushing open mega-rusty doors, bottles of unkown liquid, etc.), and best of all, it's a great bum-deflector. Any crazy crackheads come running at you, you can use it to beat them off. Plus it's compact, visually appealing, and a great party trick ("Hey! Anyone ever seen someone lose a tooth before? Johnny! *WHACK*"). Strongly recommended. Truth be known, I'm not sure how it is elsewhere, but UE'ing in the Toronto scene can be really sketchy, and that piece of 26" die-cast metal has saved my butt more than once. -Cyn

that kinda dumb.. you just would let them multiply the charges on you from a deadly weapon to robbery tools as well.. you'd be better off ditchin the crowbar and pickin up a knife if you really feel you need a weapon.. If someone gets searched and they find a utility pocket knife they won't think much of it.. they find a crowbar your asking from trouble.. But in any place I would highly recommend not carrying a crowbar because it's not something that people normally should have on thier person randomly

Because I've run into shady people and ended up in shady situations in places that I'd otherwise consider safe. If there's something that's 100% legal (like carrying a concealed handgun) that could one day save my life, I'm going to do it. And on the topic of crowbars... according to Virginia law, someone could get into much more trouble if caught exploring with a crowbar than with a permitted concealed handgun.

Makes a wonderful crowbar if the need arises, plus the obvious benefits as a weapon, plus it is totally legal to possess anywhere I might go, and I'm not stuck with "carrying burglary tools" if by chance I should meet the gentlemen in blue. I will say, however, that I have never needed a weapon to deal with another person. Animals are a different story.
I have changed my personal exploring ethics code. From now on it will be: "Take only aimed shots, leave only hobo corpses." Copper scrappers, meth heads and homeless beware. The Jonsered cometh among you, bringing fear and dread. |
