I am really new at this. I have been out once and I am excited about doing it again. You can see pics of my first UE in the photos section under Reddy Ice House Austin Tx. I have a few questions, as I am new, excited, a bit nervous about the whole process.

1) What are penalties for just trespassing (*No Vandalism/Stealing/Etc.)
2) When, UE is it considered 'OK' by community standards to break locks. etc. to get inside someplace. If a lock is broken, does that increase penalties.
3) One place I went into the other day had a homeless man living there. He seemed irritated. Is this normally a concern/problem.

1) that all depends on were you live. some places like scotland have no laws against trespassing.

2)usually we try to avoid breaking locks. its best to find a non destructive way in. if you break a lock and get caught it goes from trespassing to B&E no questions asked.

3)homeless people are found in lots of abandon buildings. respect there space and thay shouldn't be a problem

Thanks. So as long as you didn't break a lock, its not breaking and entering. Whats the standard pen. for trespassing. Ticket, night in jail?

acctualy the cop gets to decide if its B&E. you just have a better chance of not getting charged for it if you dont break anything.


as for the trespassing ticket that all depends on were you live. in canada its anywhere from a 40 to a $2000 fine.

I see.... I carry around a camera. The other day when I did the Austin Reddy Ice factory, I walked out and a cop saw me. I just started taking pictures of the outside, she circled around twice then left. Does having a camera and being like, "I am a student doing a project where I am documenting Urban decay , etc. for my architecture class, etc. " often work?

Hehe, two cops cruised by me on a street about ten feet from where I was on the wrong side of a fence of a construction site taking pictures. I didn't even notice them until it was too late to hide or anything, but they didn't do anything, so be it my holding a camera or them having better things to do, im not complaining =P

Sometimes cops are as clueless about who is supposed to be there and who is not. The cop probably thought that you worked there. Usually cops are not a concern unless you LOOK suspicious. In a construction site taking pictures, looks pretty normal during the day time, and no one has called them to report a trespasser, they are just gonna keep on doing their patrol. Now on the other hand, they see you at 1am climbing a rope up a fire escape into a known abandoned building, they are probably gonna stop and find out what you are doing.
It really depends on the situation and how you are carrying yourself. Running from a cop is ALWAYS gonna get their attention and they Will chase you. (you must be hiding something, right?) On the other hand, you are walking around like you belong there, or like you might actually work there, probably will not cause them much concern.

Now this does not apply if your location is known to the police to have visitors who party, grafitti or has had previous complaints about trespassers, then, yes, your presence WILL attract their attention.

I guess what I am saying, it all depends on the situation, and they are all differnt.

Can't find any info on the punishment for trespassing in Utah, but my guess is that if you are a minor, the fine will be lowered, you might get community service, or even just a warning. Like previously mentioned, it's all about the circumstances.

not called b&e in Texas its called burglary even if you dont steal something burglary of a business, burglary of a residence, burglary of a motor vehicle etc

If the location in question is a residence (bed inside, even a vacation home), your looking at about 6 - 9 months easy. The law does not look favorably to people "exploring" other peoples homes. Businesses also don't like intruders and may prosecute, burglary of a business, first offense . . . maybe 3 monthes in the county (bring a book to read - been there done that). Tresspassing some abandoned building or site, first offense . . . probably probation. Bring along some lockpicks - you are now a burglar in possession of an instrument of crime (picks, even a screwdriver can be an instrument of crime) bingo - go straight to jail, do not pass go!! I went to the police academy before I turned to the dark side and became a cat burglar (judges frown upon cop wannabees turning to crime, by the way) so I know from experience and from talking to my fellow cellmates (two years worth of cellmates). Prison sucks . . . dont get caught!!

I agree with Hammer. While lock picks and tabi's are definitely cool and incredibly handy they don't lend well to social engineering. It's much easier to talk your way out of trouble with a flashlight and a camera. Barring that, the charges are likely to be less than if what they would be if you were caught with such instruments. In the military they say: KISS (keep it simple, stupid.)

I'm a really bad liar and some cops can smell a lie a mile away. You really don't even have to lie in a lot of cases. A simple explanation that your hobby is to take photos of abandonments can sometimes get you off with a warning. All situational of course.
