Legal Concerns?
< on 6/6/2009 6:32 PM >
Posted on Forum: UER Forum

I am fairly new to Urban Exploring, I have just finished my 7 day grace period and am now able to post on these forums

I am a little apprehensive about posting any photos though. I am concerned because I realize that Urban Exploration can sometimes involve things like trespassing. When I signed up here I gave my name and the general area in which I live. My concern is that it would be possible for authorities to track me down if they really wanted to.

For example if I posted pictures of myself inside and abandoned building, and a week later someone else burt it down. The police might be able to prove I was there prior to the incident and I could become a suspect for arson.

Does anyone have an opinion on this?
Am I just being paranoid?

Thanks in advance for any responses

Why not not use your name and give a fake location?

There is always that risk, though, however in practice I suspect it is exceedingly minor.

I generally don't specify where I took a picture unless it's in conversation. Trespass won't be a problem for pictures, and I think you could establish beyond reasonable doubt that you were there for things besides setting fires. But mostly try not to get in the press a lot ;)

There's a great little guide to the Trespass to Property Act here, written by a handsome individual...

http://www.uer.ca/...d=1&threadid=66590

Note that it is a Provincial Act which means it differs from Nova Scotia's Act but for all intents and purposes you can use much of the information to your advantage.

Your act is here:
http://www.gov.ns....atutes/protect.htm

Key notes:
- six month limitation on laying trespass charges after the fact
- even if an arson did occur, the onus is on the police to prove that you committed the act, not for you to prove you did not

I think you are just being paranoid but that does raise an interesting point. i would say when you take picture take as few of yourself directly or have a resperator or some other type of mask on as well as a hat if it really does concern you. also just remember to have fun with it! you will be fine.

Thanks for the info!

I was just using the arson thing as an example. I was mostly wondering about like general trespassing charges or being falsely accused of vandalism or something like that.

I am not so much concerned about showing my face and stuff. Just that my general information is now available and if i post pictures it provides evidence that I have been there.

I'm not all that worried about it. I am more interested in the opinions of UER members

I dont think anyone on this site has ever been prosecuted cause of some pictures they took and posted.

Its really hard to prove you were there unless they catch you in the act.

I think if your thinking about legal repercussions , then maybe your thinking a little to hard and misguiding yourself about what the hobby includes as its dangers as well as consequences.

Ive never once thought to myself, If I go over that fence or jump through this window, what going to happen to me ? No worries and No regrets , just do it !

It would be no fun if it was too easy.

Thanks alot. I should have asked if anyone on the site had ever run into trouble in my original question.

No, but there were some related incidents of sites getting tagged with the screen name of a certain UER member, but wasn't done by them, which prompted said member to request that entire locations that they'd posted be yanked from the database, in part so they could avoid legal issues.

Yes but your case is slightly different. You posted details of being on an island where there is an active nuclear submarine base. So yeah warning to others: don't do that.

I've been a criminal defense paralegal for more than a year now, and I've yet to see one person charged with trespassing (not that it doesn't happen of course, I just think it's pretty rare).

They came after us after seeing my pictures on flickr. Just because it was a high profile location doesnt mean its not related.

That's what I was implying.

And also another user got arrested this morning over something he had done and posted pictures of. But that is a bit different. Seeing as it wasn't trespassing that he was charged with. of course I'm referencing ULYB in the "Limelight" thread in UE Main.

But for the most part posting pictures of a location shouldn't be too much of a hassle.

Whether you post them or not, it's much much much better to be more paranoid than not and be safer than sorry.

I actually agree with this kid...

I've been investigated by two other organizations as well because of pictures I've posted on the web, and I didnt even post the location names. The NCIS are the only ones who have actually stuck me with any charges so far. If you are unsure of whether or not to post something, just dont do it.
