Theft of our photos
< on 7/15/2008 11:35 AM >
Posted on Forum: UER Forum

Anyone else had issues with theft of photos from flickr as in people publishing them on things or pages without telling you a thing hoping you don't catch them?

Flickr makes it easy to share our work, but it also makes it very easy for photos to be stolen, because you can search them so much easier with the tags.

One of mine found its way onto a photo section maintained by a trade magazine publisher.

If you go to his photo section, quite a few of the photos look like someone's UE set.

I really hope they're not using UEers photos in their for-profit magazine as well.

It's copyright infringement, not theft.

Send them an invoice for usage, or sue them for copyright infringement.

As they said above, of its your copyrighted work send them an invoice or a nastygram. They'll probably immediately take it down, or they can annoy you and keep using it. it just depends how much you want to go after them. Sometimes it's not worth the hassle. Usually most people will comply in your first attempt.

I am very new to flickr, but when you upload a pic, in the advanced options, there is a an option you can use to disable web searches from seeing your pics. Not sure if it's effective or not - haven't tried searching for my stuff yet.

Finally, I think it also makes a very big difference if they download your pic and use it, or if them simply link to your pic which is still hosted in flick. I'll probably get flamed for this one, but that's how the internet works.

If someone links to your pic, it's not really that evil. Just like in these forums, Avatar-X didn't take down a pic of Lord Rick's child because it was only a link to Lord Rick's own Myspace. Though if would be nice that if someone linked they'd ask for your approval and mention you as the artist. However if you don't want it linked to, don't upload it.

As for if someone downloads and uses your picture, possibly in a commercial way, and edits them, etc, well then you send them a nice letter. Search the internet for sample DMCA letter (here is one http://futurequest...MCA/DMCANotice.php) and send it out. Get the ball rolling.

Also if it's being used on something larger like Google images or youtube, a lot of the big providers will recognize your DMCA and take it down.

If the offending person doesn't take it down themselves, contact their ISP/webhost. If you can provide proof, the ISP will also most likely comply.

I hope this helps.

Please note, I am not a lawyer and for any legal matters you should contact the advice of an attorney. Though I do read lots of Slashdot and this is how it normally goes down. I also stayed at a Holiday Inn Express last night.

That Lord Rick example was completely irrelevant. Your trying too hard.

Why? It's an example of someone who took a photo and didn't want someone else on the internet using it. The only differences are that it was hosted on Myspace not Flickr and that the photo sucked instead of being a quality photo. On top of that it involved UER. I actually do think it is a valid example of linking to a picture versus downloading it an using it.

Difference is nobody posted that photo with intent to use it as their own or imply such a thing. They posted it to illustrate a point, and everyone knew where it was posted from. If its on the internet and its a public photo, others can use it unless you claim some sort of copyright. Flickr photos are protected under copyright unless you choose otherwise. So if someone uses it they technically need permission or to explicitly state whose work it is. If you post a picture on myspace on your public profile its free for anyone to use.

Let's see here..

http://www.we-love-elevators.us

I think the url pretty much says it all. I know it hurts whenever some obscure internet site hotlinks your photo without permission, but come on.. there's a time and place to go after people for doing it. Ask yourself "is this site really profiting from the use of my photo?" and then pick your battles accordingly.

They publish trade magazines... which they charge money for subscription. So perhaps so.

I think it's pretty obvious that their "magazine" is fake. They even say so here:

"One Stop Elevator magazine may not be real but these products are and all proceeds will be donated to the Elevator Escalator Safety Foundation."

http://www.cafepress.com/onestopelevator

Anyways.. I don't know what picture they're using, but it's not like this is an advertising agency or something here. Just let it go, and yes.. welcome to the land of internet.

Yea... if it's on the internet it's pretty much fair game for anyone. You can use a watermark on your pictures, but even that can be removed in photoshop.

Also most images uploaded to Flickr are uploaded under the Creative Commons License and as long as they put that the image came from Flick they are allowed to use it.

Scroll down that link you posted:

Copyright Issues

"Please do not send me any images that you do not own or have the copyright to distribute. If you see an image on my site that you own let me know...
I will remove it or give you credit and a link back to your website."

Appears he will just remove or give credit. Doesn't look like he is willing to pay, just remove if that's the case.
And come on...anyone that uses ComicSans and that GOD AWFUL template for their site, can't be taken serious. You would never get anything out out of that site, just make his life painful and make him remove it.

...ComicSans...

You know, I read recently that ComicSans was created for a specific purpose, perhaps Clippy's speech bubbles. It's like the engineered virus that escaped the lab. Somewhere, there's a font designer who's very careful what he admit to, and to whom...

Anyway, the only fair approach to the copyright issue here is to visit the perpetrator personally, and force them to sit through a slideshow of your entire photo collection, eyes propped open Clockwork Orange-style.

I had a site ask for permission to use one of my photos from Flickr.
But, to my knowledge, I haven't had anybody use one without permission.
