| | | nothing like going equipped A canuck example would be the CCC: Section 309(1) of the Criminal Code of Canada specifies that the possession of burglary tools in suspicious circumstances is an offence punishable on conviction by up to 14 years in prison
tell you what even 4.5 years 1/3 the sentence for good behaviour is still a long time in the Pen

| | | Haha, I think that code applies to more valuable buildings... I'm pretty sure you wouldn't get convicted if u get caught walking into an abandoned building via the 12foot diameter hole in the wall... lol It's all about situation. My technique for avoiding fuzz problems is pretty simple. SPEAK A DIFFERENT LANGUAGE! haha It's actually the same way I get out of tickets. In Canada all govt. services MUST be offered in French. So a little quick Quebecois...usually goes right over their head. Guess that doesn't help our Southern neighbours... but hey, for the Canadians on here,

| | | Just hope you get caught by a security guard before the police if anything. Im sure it would be easier to sway a security guard over a cop, but it all depends on the person. getting caught sucks, dont do it.

Yeah walking through a wall is no problem, but if you are found trespassing, and you have any suspicious tools (crowbar, lock pick, torch, glass cutter, etc..) then you can be arrested and possibly serve time.

I have. He was using it to heat up a lock so that it was easier to cut with the bolt cutters he was carrying.

| | | Being honest and respectful will work most times. Playing stupid and naive has also worked for me. My favorite was being caught by the owner of a factory I was trying to get into. I had my dog with me (a St. Bernard) and I told the owner that obviously this 175 dog is taking me where HE wants to take me. Then I complimented his "beautiful old building" and he took me in and gave me the grand tour.

| | | This is very informative stuff. The other thing I would like to know from anyone who may have been unlucky enough to be in the situation: Does the presence of additional gear such as flashlight(s), screwdrivers--in short, any UE equipment besides the camera--affect the judgment of a LE officer who may question you? I'm not talking about B&E tools (although a screwdriver could be seen as such). But about one of the many basic variants of a UE kit. Stuff like flashlight, gloves, headlight, etc. [last edit 2/21/2007 2:37 PM by Draghignazzo - edited 1 times]

A screwdriver is a B&E tool when your found with it trespassing, especially if you used it to gain entry It's used to loot and as a weapon as well.
Just when I thought I was out... they pulled me back in. |

| | | I got caught on Federal Land once. State Troopers got us (3 of us). We told them what we were doing and that if they wanted we would leave. So they checked our IDs and told us to leave. So I say if your in a known UE arear, like we were, they know what your there for and just be straight up with them and you'll be okay.

| | | I think it's also a really good idea to know the trespassing laws in your state... I know here in NJ, the law says valid defenses are as follows: (1) A structure involved in an offense was under subsection a. was abandoned; (2) The structure was at the time open to members of the public and the actor complied with all lawful conditions imposed on access to or remaining in the structure; or (3) The actor reasonably believed that the owner of the structure, or other person empowered to license access thereto, would have licensed him to enter or remain, or, in the case of subsection c. of this section, to peer. --A person commits a petty disorderly persons offense if, knowing that he is not licensed or privileged to do so, he enters or remains in any place as to which notice against trespass is given by: (1) Actual communication to the actor; or (2) Posting in a manner prescribed by law or reasonably likely to come to the attention of intruders; or (3) Fencing or other enclosure manifestly designed to exclude intruders. Best idea? Don't get caught!! And ignorance of the law is not a valid defense...
