i had a truck hauling rocks pelt my 96 Cavalier, destroying the windshield and dinging the hood (which i had just painted)... I called the company (Carrara Concrete in Middlebury VT), gave them the truck #, trailer #, VT Tag number and they told me good luck. I called the VT State Police and they said that construction trucks weren't responsible for road damage. that cost me about $500 in damages. fuckers.

This happened on my way into work, on I-81 near Binghamton. Fortunately, somebody had called 911, and this guy was getting pulled over just as I got around him. I pulled over with him and the trooper. There was nowhere to go since there was a car in the other lane. The statey cited him, and my insurance company has no doubt he'll be held responsible.

i wish mine had turned out that way. even the state gave me a 'fuck you' over a shattered wheel on the same car as I mentioned earlier.

I use to drive em. Its the drivers responsibility to check for loose stone on the back of the truck as well as the tailgate latch. The truck companies will put a stay back 200' warning on the tailgate as you can't keep some stone from getting loose. Most companies will cover a windshield but that's about it. Its a double edge sword. On one hand you don't want any product to come off the truck, but on the other hand if the driver spends 20 minutes per load looking for any possible loose stone either the companies looses money or the driver (as some dump truckers get paid per load).

Our local gravel company has stickers on the back of their trucks that say "Not responsible for vehicle damage" Uhh... it doesn't work that way, guys. That's like wearing a shirt that says "Not responsible for getting you pregnant"

Yep, did it for a while myself. I also always covered the load, which nobody ever seems to do. I understand the loose gravel, but his tailgate was flapping in the breeze every time he hit a bump. Crazy shit. He's lucky he didn't kill somebody.

At the distribution center I do gatehouse duty on the weekends, the shipping clerk while driving home one day had a load bar fly into her windshield nearly missing her all because the driver forgot to secure the rear doors.

The good news here is you weren't on a motorcycle, and that the guy got pulled over, and you will get the damage fixed at their cost, hopefully low or no deductible. Getting gravel with my pickup, they tell us to check the bumper for material, a good habit. His open tailgate = total fail. Talking about stuff on the road, almost every night on the Seattle traffic report there's something 'blocking the roadway'. Yesterday was boxes, before that a carpet. Dishwasher? That would be cool to see if it didn't cause an accident. In Toronto I saw a truck carrying a construction bin, he had just dumped it on the median because something was on fire in there. Best miracle story I heard was a steel bar fell off a truck, bounced up and through a minivan's windshield, then lodged itself in the middle seat, inches from the kid in the baby seat... I've driven the "pike". That's actually more unusual than a body. Who the fucked designed that piece of hell??? Off ramp, no on ramp. On ramp no off ramp. Exit and the bridge under the pike is 12' and to the right is a bridge that's 13' even. And no sign on the interstate saying such. Trucks are 13'6"'s btw. Arrrrrrrrrgh. And oddly enough I love Jersey

Law here says trucks are responsible for items that fall off of them, but not items kicked up from the road.

About 11 years ago, I nearly ran into a couch that had fallen off a truck on the highway (QEW east of Cawthra) while going home. And before that while on the 401 heading to Oshawa, I saw a ladder start flying off the truck ahead of me. I let off the gas and was ready to hit the brake when the ladder hit the road and start sliding. Luck was with me because the ladder was facing with the lane and I was able to straddle it with my truck. No damage but if I was about 4 feet closer, I would have had that ladder hit the front of my truck.
