if caught on the roof of a building, say downtown, without permission taking light trails of car lights as they drive by, would it make a difference if you removed the sd card? Or prob not cuz your just shooting a street? I know in a home or on pub prop. you wanna switcheroo.
But since I was thinking of giving it a go tonight I was curious if anyone had any actual facts on the matter. I'm gonna guess and say trespassing is trespassing probably. If anyone knows it would help out.

I don't think it would matter. I mean, if you are caught, it would be pretty obvious that you were taking pictures, card or no card. Nothing illegal about taking pictures of things (unless specifically prohibited). Besides, I don't think you would have the chance to switch out the card anyways. Now if you're taking pictures of people through windows while on the roof, then you may want to swap the card somehow if caught, because then you're a peeping Tom and then you can actually get charged.
I was caught on a roof once, without a camera, just hanging out. He was a security guard that was a little confused that we were up there, he told us to leave, end of story.

Mr_Fiend got it right, removing your camera card would only make sense if you were taking photos of something where the photos themselves would be the crime.
I guess such as a prohibited government area where it says no photos or if the photos proved you were indeed inside or on top of someplace prohibited.
If they already saw you on the roof, then theyve already caught you on the roof, camera, camera card, or not you were on the roof right?

I think (in many situations) it is better that you are "just taking pictures". It is evidence that you are not a thief or a vandal.

It's not illegal to take photos, but photos can be evidence of other illegal activity. For instance, if you are caught outside of a building, but have photos of the inside of that building it would prove you were at one point inside. (or on top of a building). It all depends on how aggressive the local LEO wants to get about things -- usually it's not an issue to worry about.

Well, obviously, if you are not supposed to be there in the first place, this is not a matter of whether or not taking pictures is illegal or not.
For example, if you are caught by security personnel who work in the building (instead of the usual rent-a-cop), it's the property owner or management's protocol that will be giving the final word on whether or not you are allowed to leave with pictures.
Whoever catches you is going to give you two choices: Delete the pictures and leave the property peacefully, or refuse to delete the pictures and get your camera gear confiscated/ be arrested for trespassing/ or both.
Are you really going to say no? And then settle for being arrested?
I don't think so.
But there are several different ways of hiding an SD card, or fooling people into thinking you are deleting everything. I, for example, have a camera with two SD card slots. I haven't really given it much thought until recently. (SD cards do become defective or lost, even though it's rare.)
I can assign the second card to automatically make a clone of the first, and this is the best possible solution for three different reasons: 1) Having two cards allows you to quickly eject the backup and hide it. 2) Deleting pictures from the original card will usually be enough to fool anyone into thinking you are deleting all of your pictures. 3) This is not an Eye-Fi backup system, which probably doesn't always work.
