Well... lots of BAD info here, depending on what state youre in. Too many episodes of Law and Order maybe.

Depending on state: Breaking and entering might be actively opening a lock. Or opening a window. Or even reaching through a open window.

Depending on state: Breaking and entering might not even exist. Or it might be an element of burglary.

Depending on state: Burglary could be just crossing a plane, door, window, car window...

Depending on state: Burglary has nothing intrinsically to do with stealing. You can get charged with burglary if you walk into an unlocked area looking to attack someone.

So if you're that worried, there are plenty of lawyers who have info sites set up explaining what is what in their particular state.

Be sure to check the laws in your state regarding lock picking (possession of picks, any enhancements for possession while committing a crime, etc.), so you know what your penalty will be if you get caught with them.

I would also suggest keeping them within a quick arm’s reach (not in a backpack) so that you can toss them immediately if necessary.

And lastly; Practice, practice, practice!

OH yes check your local laws. UK you would be charged with "going equipped" or attempt to Thieve. Used to be most of the time I have been stopped on a explore, had a PNC(police national computer) check on my details for outstanding warrants etc. If caught in the building perhaps, 5 hours in the cell and interview, chucked out and told to bugger off. If the PNC check is clear they may just tell you to get out the area. Or if they get your name co-operate as it will just mean a warrant being issued for your arrest anyway.

I can pick and as already said practice is the key in the real world rusty pins are your biggest problem. keep them in a place they can be launched or hidden some place for reasons above being caught with them.

You know I think it is about time I learn to lock pick. There's this semi abandoned factory district that has some pretty cool spots but I learned the hard way bolt cutters only get you so far. Ugh yet another skill this hobby has shown me I'm inadequate at. ☠️🧙‍♂️✨️
