So I was done work early today and my spidey senses tingled so I decided to go down to the Hearn.

As I was coming from the east side, I could see cop cars inside. There must've been around 10 of them at one point cause as I was walking closer, I could see bunch of them leaving heading west, 4 at minimum...

I'm not sure of what happened there but it looked serious... I ask a leaving officer what was going on and the response was: "somebody decided to walk in there". It can't be the whole story otherwise the security measures are off the roof there... I didn't got a solid count but it must've been 10 cars and at least one K9 dog...

If you guys got more infos I'm interested to know why there was such a big amount of police forces there.

Where's what I was able to capture: (Good thing I also happened to have my 250mm on me!)

1. First picture through the bushes and the fence... (4 cruisers)



2. Hard to see but you can see some K9 legs right behind the bumper...



3. Better shot of the K9 sitting next to the poll between the 2 persons. (same cruiser as in picture 2)



4. Police cars parked by the front door on the south west corner of Hearn, (4 extra cruiser)


5. Golf cart located by the south west door.



6. This is 2 of the many cruisers that left behind at least 5 more cruisers on site.

As discussed, there must definitely be more to the story than what was given up to you. A K9 response is excessive for a trespass, especially with the way TPS responds to things haha.

The news today has been about 800 cops taking down gang members. I wonder if this has to do with that? Perhaps one of their targets being in the area.

I really hope my thoughts are true as I have yet to go to the Hearn, and it is the place I want to visit most.

Although not until next weekend, I have a family member who is a cop with TPS, who I'll "interrogate" to see what I can find out. Whether about this situation, or K9 dispatch protocols/trespass response.

Nah, this dude at my school said he went into hearn once last year I think with a couple friends (not an avid explorer by any means, just for shits...). They made some noise and the cops were called. He said there were at least 10 cars, K9's, the whole 9 yeards...

They made him lay on the ground and all that, all the while K9's were barking their heads off.

Seems like the usual response there!

TPS have used K9 previously for trespass (albeit infrequently), so it's not out of the question.

I can confirm this is the normal response to a trespass at Hearn. A good friend of mine went around 8 months ago. Around an hour after they entered 10 cops show up and bring K9's into the building. He has the entire thing on film too. Looked insane.

Your going to be surprised. My buddy was rolling with a squad with about 5 or 6 people. The cops came into the building screaming at them to get down (they were on the 4th floor). They had the K9's barking there asses off on top of it. They went down, sat them on a curb and yelled at them pretty aggressively. The main worry for the cops were if anyone had paint. They were VERY keen on the paint. They ended up letting them all go on just a warning. The cops made a joke when they were leaving saying "I'm letting this dog go and the first one to get caught is getting a trespassing ticket". The video is not online but ill try and get him to send it over!

It looks like Toronto police are starting to take an American approach to policing trespassing that's disproportionate to the offence of trespassing--a provincial offence like a speeding ticket. With that said, it's usually a small group of high-profile property owners that get special treatment from the police.

Also, don't think Ontario's generally low-level view of trespassing applies to other jurisdictions with similar legal systems, like Michigan, for instance. The Americans treat trespassing as a criminal offence. If you get caught in Michigan, you may have to show up to court for an arraignment where you enter your plea (guilty/not guilty) and then show up again to court for a trial and/or sentence (fine or imprisonment). Unlike in Ontario, you can end up with a criminal record for trespassing in the US.*

*There is a criminal offence in Canada for a type of trespassing: trespassing "by night". Its purpose is to criminalize "peeping Toms" who trespass on someone's residential property to invade their privacy (e.g. to look through their windows).

Like the atmosphere surrounding the Malting Plant following Dead Police painting the most visible portion (to the city) a decade ago, the massive Forte / Causr piece on Hearn from a few months ago has an entirely different police interest than the regular 'just trespassing' -type business.

Liability for what? If you're trespassing in Ontario, you generally can't sue for injuries you sustain, according to s. 4(3) of the Occupiers' Liability Act:

Trespass and permitted recreational activity

(3) A person who enters premises described in subsection (4) shall be deemed to have willingly assumed all risks and is subject to the duty of care set out in subsection (1),

(a) where the entry is prohibited under the Trespass to Property Act;


Thus, there is no liability issue. Police generally don't concern themselves with civil law issues anyway.

Perhaps the authorities are concerned that any sort of rescue would be a drain on public resources. Also, incidents involving injuries and death attract more public scrutiny as to whether everyone involved (including the police) is doing their jobs properly.

Good point. However, there's more to it than just trespassing. Here's the definition of criminal mischief in Canada:

Mischief

430 (1) Every one commits mischief who wilfully

(a) destroys or damages property;

(b) renders property dangerous, useless, inoperative or ineffective;

(c) obstructs, interrupts or interferes with the lawful use, enjoyment or operation of property; or

(d) obstructs, interrupts or interferes with any person in the lawful use, enjoyment or operation of property.


Most of the trespassing that gets posted here does not involve damage/destruction to property or obstructing other people's use of property.
