What I would do if your worried about being from another country get someone else from the forum that pictures he stole that are from the same country(I can tell you it in 4-5 days). In theory if you show proof that they are yours(Maybe use flickr and mess with the settings to make it be private images or whatever its called) I am not positive but if enough people file complaints even if they are not taken Youtube should remove his content. So I would start trying to find people whos content he has used.

As far as I know, Youtube is asking for a proof that you have filed a suit, not proof that you have served him with the papers?

I would think you could theoretically sue for costs + revenue + licensing fees you would charge (I would charge somewhere in the $200 range for a commercial use of the single image) + maybe some kind of penalty. Might be difficult to file a cross-country suit.

Also, he seems to have just over 200 subs and pulling in somewhere in the neighborhood of a dozen views on average, which means his ad revenue is basically nothing.

You might also try a formal cease and desist letter copied to YouTube - that has at least some legal weight without the cost of filing a suit.

My 2 cents here:

This guy is foreign. And sadly a lot of mis education and ignorance exists outside the US with regard to understanding that an image is someones property and cant just be reused because it's on the internet.

If you do not file a claim of some sort it can eventually negate copyright law for that image- meaning, if you just let it slide and he keeps using your image without permission you have set a precedent that basically says you have no value placed on the image and it's fair game for anyone to use.

This is why we see starbucks and other major corporation suing people all the time for mis-using logos, even as satire. It's a way for them to constantly set a value for their brand materials.

Even if he's not making money, it's still not fair use. Fair use is for things like reviews or parody, not to just take people's images and compile them without permission. He's also using a ton of images with stock site watermarks, which means he's stealing the previews off stock sites which is ALSO illegal, but the claims have to be brought by the rights-holders.

Basically, he's a piece of shit but it might be difficult to take him down without a few rights-holders filing claims.
