Just now seeing this - kind of funny because I, too, nearly got busted at a scrap yard.

I wasn't inside the place, just walking around the perimeter taking photos of some vehicles inside. However, it's not a very good neighborhood by any means, and a suspicious citizen thought I was a scrap thief looking for a way in (which there wasn't, save for going over a pile of concrete and rebar).

I played dumb and said that I saw no "no trespassing signs" and therefore didn't know I was trespassing. This was true, as the only signs like that were on the gates leading into the scrapyard. Luckily I got off the hook with nothing but a warning and a database check, but I will not be returning there again.

tl;dr Even if you aren't exploring or going inside, hanging around scrapyards is a bad idea.

Yeah, the only reason I was at the scrap yard was because it was adjacent to a large industrial location I was exploring, and the workers were actually in the process of scraping said location.

Since the only crime you committed was trespassing it's unlikely they will charge you if they haven't already. Feds and military will be able to view that report most likely though, so if they ever ask you about while doing a background check for a Fed job, don't lie about it. Universities and private employers won't be able to find it; you were never arrested.
Don't go back there -ever-... next time, in the same situation consider asking permission. The only drawback to doing this is if they say no and catch you in there later and remember, that will probably get you arrested.

Make it worth the effort if you're going to trespass. A scrape yard? Meh. A decommissioned missile base on county land? Hell yeah.

T workers were probably being so cautious for a couple of reasons. The first being liability (getting hurt there could cause them alot of hassle), and the second being their fear. When they saw you with a camera they may have thought you were photographing unsafe conditions or environmental practice issues.

You definitely shouldnt return, and you shouldnt be concerned. Now, if youre caught again, the police will have record of you being caught in the past and may be a little more strict.

That's probably it. The only chemicals they bothered to remove were the carcinogens in the chemistry lab. Everything else (lime, sulfur, etc) was left around. Frankly, they were more worried about my camera than anything else.

Lime is not an environmental concern; caliche roads are common in W TX. Not sure why they would have sulfur?

Fence offed land around a business means private property.
Get an invite, be stealthy... or pay the consequences.
Hiding usually means you're doing something illegal. Be glad they didn't have you arrested for trespassing. The fact that police contacted you meant the owner was pissed. Fortunately not enough to press charges.
Consider it a free lesson.

Hmm, didn't know that about lime. The sulfur was weird, though, and there were leaking barrels of oils, lubricants, and other such industrial chemicals laying around.

As for the free lesson... well, I've certainly learned a little bit about caution and stealth from that. I don't have any plans to go back there, of course- I'm not crazy.

Caliche is also commonly used for spill clean up. Caliche will absorb and hide many a gallon of oops. Given time hydrocarbons will eventually evaporate especially in the desert

It could have been bad timing and luck too, such as you just happened to be there snooping around the day after something of value was stolen.

Sometimes you could just walk up the main entry, say you're there to take pictures and get permission. If they say no, move-on. This is especially true for something dime a dozen like junk yards. People on site were doing other work. I walked up, straight up said I want to look around and take pictures in middle of the day. They said ok. Parked in plain view and I checked out when I was done. This place was perfectly preserved and only decaying naturally. Neither looted nor vandalized. Electricity is still on.

If you snuck-in, they'd probably going to think you're a scrapper or a vandal and I don't think it would go too well.

I know that your specific example is long since over now and this is an old thread, but I figured I'd share some knowledge about what actually will show up on a criminal database search if your information taken down by cops but you aren't charged or arrested. I used to work in the courts (Texas) and had access to the NCIC/TCIC records and the answer is no, an incident such as the one that happened to the OP would not show up on a national criminal database. The only things that show up on a national database (even for law enforcement unless they are the same local municipal PD that took down the info to begin with) are arrests, charges (even non-convictions will show up if you were charged with anything worse than a minor traffic or parking violation), probations/paroles, jail time, and database registries if you're a sex offender.
In Texas, these minor infractions not entered into the NCIC are called class C and D misdemeanors. Regardless of what other states call these types of violations, they don't go outside of city municipal jurisdictions. The only way to find these types of violations is to contact a city directly, which obviously would require some specific knowledge. I had to track some of these minor charges down a couple times when I worked in the courts and it's a huge pain in the ass because we would have to actually call every municipality that would possibly have a record on a particular person one at a time. This was only done if the judge specifically told us do it and was an exceedingly rare occurrence.

In the OP's case, there was never a formal charge, so there is no database entry. Only his local PD will (presumably) retain and have access to the info.
