Entry: Trespass Law - Sweden
originally posted by Bewern

Swedish penal code, section 6: Trespassing:
Any person who unlawfully intrudes or remains where another has his residence, whether it's room, house, yard or vessel, shall be sentenced for trespassing fines.

Enters or remains unlawfully someone else in office, factory, other building or vessel, the storage area or in any other such site, shall be sentenced for trespassing fines.

If the offense in the first or second paragraph of said gross, shall be sentenced to imprisonment not exceeding two years.

Comments from Swedish law:
Hemfrid Crime covers both ordinary burglary and a situation where a guest does not want to leave. As the housing cycle, a place that is inhabited and can therefore relate to both cottage and tents. In cases where several persons living in a dwelling, it is sufficient that one of them asks a guest who does not live there to leave and that person refuses, for it to be considered as trespassing.

Illegal entry mainly refers to an area where people work. The classic burglary covers all places where you unlawfully intrudes. But to illegally remain firm a merchant port banned someone is not punishable if it relates to a place where the public has access, such as a store.

In assessing whether the offense is grave examines whether there has been systematic, planned, how long the interference lasted, if demonstrated ruthlessness, outbreaks of violence or vandalism. Harassment of employees was deemed very important.

In Sweden we have "allemansrätt" - Right of public access:

This gives you the right to be in the nature and pass ower other peoples ground, walk on roads, pick flowers, berries and mushrooms. But you have to be careful. Don't be on ground just around housing, on ground where people are growing plants or where live stock are living. just think: Don't destroy - don't disturb!
